خلاصة:
وجود وصف مهم و اساسیِ آمره بودن در قواعد حاکم بر صلاحیت، تضمینی برای اِعمالِ صحیحِ حاکمیتِ دولت در معنای عام و همچنین برقراری عدالت در عرصههای مختلف تقنینی، قانونی، قضایی و اجرایی است. به همین دلیل، رعایت قوانینِ ناظر بر اجرای صحیحِ قواعدِ صلاحیتْ امری است مهم که میبایست مورد توجه دستگاههای مختلف، از جمله محاکم قضایی، قرار گیرد. این در حالی است که وجود برخی شرایط خاص و استثنایی سببِ نقضِ قواعدِ صلاحیتِ محاکمِ کیفری میشود، که به آن «استثنائات صلاحیت» گفته میشود. در این میان، نظریۀ مشورتی ادارۀ حقوقی قوۀ قضائیه، به شمارۀ ۲۴۶۲/۹۳/۷، حکایتکنندۀ استثنائی دیگر برای عدول از قواعد صلاحیت است که فاقد مبنای قانونی میباشد و بهموجب آن، امکان مداخلۀ نهاد دادستانی یا دادسرا نسبتبه جرائم منافی عفتی که بهموجب قانون، صلاحیت رسیدگی به آنها در اختیار دادگاههای کیفری قرار گرفتهاست فراهم میگردد بر این اساس، با هدف جلوگیری از امحای آثار جرم در جرائم موضوع مادۀ ۱۰۲ قانون آیین دادرسی کیفری و با توجه به مفاسد و مصالح آن، امکان دخالت در صلاحیت دادگاه توسط دادسرا، آنهم به قدر متیقن و کافی، وجود دارد. بنابراین درصورت احراز برخی شروط، مانند وجود ضرورت و فوریت برای اقدام مداخلهجویانۀ دادسرا و همچنین نبودِ قاضیِ کشیک در دادگاه جهت صدور دستور لازم، میتوان جواز مداخلۀ دادسرا در صلاحیت دادگاه کیفری، نسبتبه جرائم منافی عفت را مورد پذیرش قرار داد.
