توسعة شگرف تکنولوژی و افزایش شرایط و محیطهای خطرناک منجر به افزایش و تنوع مصادیق ورود زیان به اشخاص و در نتیجه ضرورت توسعة نهادهای حقوقی برای مقابله با چنین زیانهایی شده است. نهاد حقوقی «هشدار» یکی از راهکارهای حقوقی است که در نظامهای حقوقی پیشرفته برای مقابله با زیانهای یادشده توسعه یافته است. این نهاد حقوقی علاوه بر پیشگیری از وقوع چنین زیانهایی مانع ایجاد مسئولیت مدنی تولیدکنندگان یا کاهش آن و همچنین سبب رفع یا کاهش مسئولیت متصدیان محیطهای خطرناک میشود. اما متأسفانه در نهاد قانونگذاری نظام نوین مسئولیت مدنی دربارة این موضوع مهم توجه شایان ذکری به این نهاد حقوقی نشده است. نوشتار حاضر به ارزیابی دیدگاههای موجود در خصوص نهاد هشدار پرداخته است. نتیجة پژوهش حاکی از آن است که معیار «توجه به تمام اوضاع و احوال حاکم بر قضیه» از مطلوبیت بیشتری برخوردار است و نیاز به احراز همة شرایط نیست.
Astonishing developments in technology and the rise of dangerous settings have increased and diversified examples of situations that may inflict damage on individuals. Hence it has been indispensable to develop legal institutions to counter such damages. The duty to warn is one of these institutions that has been developed and applied in modern legal systems. The duty to warn not only has preventive effects; it also can prevent manufacturers' civil liability from happening or at least it can diminish it. The duty to warn can also prevent or lower civil liability of operators of dangerous settings. Despite these pros brought about by the duty to warn, our legal system does not deal with it adequately, if not at all. This article critically examines the existing scholarship on the duty to warn. It concludes that "all circumstances of the case" is an appropriate criterion to adopt in order to establish liability.
