خلاصة:
L’immunité de juridiction des Organisations Internationales apparait comme un privilège entravant le droit d’accès au juge consacré par l’article 6 de la Convention Européenne des droits de l’Homme (CEDH). Cette restriction d’accès au tribunal entraine une insécurité juridique fondée sur la défaillance du système international. Dans la pratique, la jurisprudence en la matière atteste de la nécessité de garantir au justiciable des voies de recours répondant aux exigences d’un procès équitable. L’objectif de cette étude est de révéler les limites de l’immunité de juridiction des Organisations Internationales qui a pour simple but de garantir le bon fonctionnement de ces organismes.
The jurisdictional immunity of International Organizations appears as a privilege hindering the right of
access to the judge enshrined in Article 6 of the European Convention on Human Rights (ECHR). This
restriction of access to the court leads to legal uncertainty based on the failure of the international system.
In practice, case law in this area attests to the need to guarantee the litigant remedies that meet the
requirements of a fair trial.
The objective of this study is to reveal the limits of the immunity from jurisdiction of International
Organizations, the simple purpose of which is to guarantee the proper functioning of these bodies.
