خلاصة:
دادرسی الکترونیکی به تبع تغییر و تحولات تکنولوژی و علوم رایانهای، در ایران و حقوق کشورهای اتحادیه اروپا مورد استفاده قرار گرفته و رفته رفته به متن قوانین نیز نفوذ کرده و دارای چهارچوب مدون و تقنینی شده است. در روند دادرسی الکترونیکی نیز بحث ادله اثبات دعوا و استناد به ادله الکترونیکی از جمله مباحث چالشی بوده است که در این پژوهش که به روش توصیفی – تحلیلی تهیه و تنظیم شده است به جوانب مختلفی از آن پرداخته شده و درصدد پاسخ به این مسائل بوده است که اساساً ادله سنتی و الکترونیکی در اثبات دعوی چه تاثیری ایفا خواهند کرد و هرکدام چه مزایا و معایبی دارند. نتایج و یافتههای پژوهش بیانگر این است که هم در حقوق ایران (در قوانینی نظیر قانون تجارت الکترونیکی یا آییننامه جمعآوری و استناد پذیری ادله الکترونیک) و هم در حقوق کشورهای اتحادیه اروپا (نظیر فرانسه و انگلستان) به این موضوع توجه شده و امروزه ادله اثبات الکترونیکی نظیر سند الکترونیکی، امضای الکترونیکی، اقرار یا شهادت الکترونیکی و غیره در دادرسی الکترونیکی تاثیر بسزایی داشته، زیرا همانند ادله سنتی در فرایند دادرسی موثر بوده، سبب تسهیل کشف حقیقت شده و مزایای بیشماری از جمله حفظ نسخه اصلی و ضعیف بودن احتمال نابودی آنها و البته امکان بازیابی و غیره دارد و در کنار ادله سنتی و یا حتی به طور مستقل میتواند در فرایند دادرسی تاثیر بسزایی بگذارد. نحوه جمعآوری و البته استناد به دادهها نیز از همان
Considering the growth of technology and the increasing advancement of computer science andcommunication, today, by combining these technologies and the science of laws, benefits can be added to thetrial process. One of the most important manifestations of the use of computer and communicationtechnologies is the creation of an electronic trial system. In this study which has been prepared and regulateddescriptively and analytically, all efforts have been made to understand what prerequisites and requirementsare necessary to use e-trials be conducted electronically for juvenile due to its advantages for them. Thefindings of the study indicate that issues such as online trial and providing facilities to achieve this matter interms of hardware and software, electronic notifications to children or their parents, electronic testimony ofchildren, and electronic registration of personality files and the realization of the possibility of virtual andclosed trial for children through e-trial are among the requirements of juvenile e-trial, all of which havepositive benefits for children. For example not needing their presence according to the emphasis of the Codeof Criminal Procedure, reducing the fear of dying to testify, not losing the children's cases, reducing the timeof the trial and the involvement of the child in the trial, not disclosing the information and identity of thechild and the possibility of resocialization and prevention from labeling children's identities in open and inpersontrials are among these items.
