تحلیل بایسته‌های تقنینی نقض حریم خصوصی خانواده موضوعی است که در این مقاله مورد تحلیل قرار گرفته است. حریم خصوصی به عنوان یک مفهوم مدرن و برخاسته از مبانی حقوق اساسی و حقوق بشری به حوزه های مختلفی از حیات بشر راه یافته است. یکی از این حوزه های مهم که واحد بنیادین در شکل گیری اجتماعی بزرگ است خانواده می باشد. در این عرصه قانونگذاری باید با در نظام گرفتن سیاست متفاوت به این نهاد توجه نموده و در صدد رفع چالشهای آن برآید. به نظر می رسد باید قانونگذار به نتایج منطقی برای وضع قاعده در محدود نمودن یا بسط حیطه حریم خصوصی برسد. باسیته های قانونگذاری در عرصه حقوقی خانواده از دو بعد فلسفی و همچنین حقوقی مورد بحث و بررسی قرار گرفته اند. از منظر فلسفی آرا اندیشمندان مطرح شده و تحلیل جرم شناختی پیرامون موضوع ارائه شده است. از این رو پیش فرض ها و اصولی را باید رعایت نموده که به نتایج مطلوب دست یابد. الزامات حقوق بشری نیز باید رعایت گردند. بدین منظور باید خانواده مجالی برای رشد و تعالی شخصیت انسان باشد. در این مقاله نگارنده به شیوه توصیفی تحلیلی به تبیین موضوع پرداخته است.
Analyzing the legal requirements of violating family privacy is a topic that is analyzed in this article. Privacy as a modern concept arising from the fundamentals of fundamental rights and human rights has entered various areas of human life. One of these important areas that is the fundamental unit in the formation of a large society is the family. In this field of legislation, it is necessary to pay attention to this institution by adopting a different policy in the system and try to solve its challenges. It seems that the legislator should reach logical conclusions to establish rules in limiting or expanding the scope of privacy. The basics of legislation in the field of family law have been discussed from two philosophical and legal perspectives. From the philosophical point of view, the opinions of the thinkers are presented and the criminological analysis of the topic is presented. Therefore, the presuppositions and principles must be observed to achieve the desired results. Human rights requirements must also be met. For this purpose, the family should be a place for the growth and excellence of human personality. In this article, the author has explained the topic in a descriptive and analytical way.
