رای دادگاه به عنوان حاصل فرایند دادرسی، دارای ارکان و شرایطی است که قانون برای موجه بودن لازم دانسته است. اصل 166 قانون اساسی و بند4 ماده ۲۹۶ قانون آیین دادرسی مدنی ایران به این ارکان و شرایط اشاره دارد. موجه بودن رای دادگاه از نظر ماهوی مستلزم بیان عناصری از دعواست که به عنوان ارکان رای در بر دارنده محتوای ماهوی، حکمی و اثباتی دعوا در قالب استدلالی منطقی است. رکن عمده رای دادگاه برای موجه بودن با ارائه امور موضوعی از سوی اصحاب دعوا شکل میگیرد؛ سپس با توصیف این امور توسط دادگاه به صورت جهات موضوعی نمود پیدا میکند. اثبات امور موضوعی که از طریق ادله اثبات قانونی و به منظور قناعت وجدانی دادرس صورت میگیرد رکن اثباتی رای دادگاه را تشکیل میدهد. توصیف و تطبیق امور موضوعی ارائه شده بر حکم قانون، باید در رای دادگاه اعلام شود. این قسمت از رای دادگاه را جهت حکمی رای مینامند. همه این ارکان باید در قالبی استدلالی و به منظور اقناع متداعیین و حتی عموم مردم نتیجه رای را توجیه کند.
The court's decision, as a result of the litigation process, has the elements and conditions that the law deems necessary to be justified. Article 166 of the Constitution and paragraph 4 of Article 296 of the Code of Civil Procedure of Iran refer to these elements and conditions. Proof of the subject matter, which is done through legal proof evidence and in order to satisfy the judge's conscience, constitutes the proof element of the court's decision. The description and application of the matter presented in accordance with the rule of law must be announced in the court decision. This part of the court's verdict is called a verdict. All these elements must justify the result of the vote in an argumentative way and in order to convince the participants and even the general public.
