خلاصة:
تحولات جامعه ایران از دیرباز تحت تاثیر موضوعات و مسائل مذهبی بوده است. از جمله می‌توان به گرایش‌های فقهی-سیاسی دوران مشروطیت و دوره جمهوری اسلامی اشاره نمود که هرکدام منجر به شکل‌گیری قوانین متفاوتی شده است. سوال نوشتار حاضر این است که گرایش‌های فقهی-سیاسی دوران مشروطیت و جمهوری اسلامی به چه نحوی بر روند شکل‌گیری قوانین اثرگذار بوده‌اند؟ فرضیه نوشتار این است که سه عامل دفع استبداد، محدود بودن و یا گسترده بودن اختیارات فقیه و تلقی عرفی یا شرعی از قانون، مهم‌ترین عوامل اثرگذار بر شکل‌گیری قوانین عصر مشروطیت و دوره ج. ا. ایران بوده است. نتایج تحقیق نشان می‌دهد که گرایش‌های فقهی-سیاسی در دوره مشروطیت و ج. ا. ایران با توجه به عدم اختیارات گسترده به فقها، بیش از پیش در محدوده قوانین عرفی سیر می‌نمود، اما در دوره جمهوری اسلامی، بدلیل اختیارات گسترده ولی فقیه در قانون اساسی، وجه شرعی به منزله منبع قانونگذاری و همچنین دفع استبداد در نظر گرفته شده است. اگر در دوره مشروطه، قانون، مشروط بودن سلطنت و عرفی بودن سیاست، بخشی از منابع قانونگذاری به شمار می‌آیند، در گرایش اسلام سیاسی منتج به جمهوری اسلامی، احکام شرعی دافع استبداد و عاملی برای قانونگذاری در نظر گرفته می‌شود. روشی که پژوهش حاضر مورد استفاده قرار می‌دهد، توصیفی-تحلیلی و بهره‌گیری از منابع اسنادی و کتابخانه‌ای است.
