خلاصة:
زمینه و هدف: امروزه، مهمترین معیار برای تعریف اصل «لزوم رعایت تشریفات قانونی و عادلانه»، حمایت از شخص انسان در برابر رفتار خودسرانۀ حکومتها، و در برابر تعلیق خودسرانۀ حقوق و آزادیهای بنیادین بشری است. عدم رعایت اصول ضرورت و تناسب که مقتضای این اصل است مخصوصاً در جریان محاکمات کیفری، موجبات مسئولیت بینالمللی حکومتها را فراهم میسازد.
روش: مقاله حاضر توصیفی- تحلیلی بوده و از روش کتابخانهای استفادهشده است.
یافتهها و نتایج: حق دسترسی به دادگاه بیطرف و مستقل، حق بر محاکمۀ سریع، اصل برائت، و... ازجمله حقهایی است که در کنار حاکمیت قانون و استقلال قضایی، در پیوندی نزدیک با عناصر دیگر، بهویژه «دموکراسی» و «قانونمندی» محتوای اصل لزوم رعایت تشریفات قانونی و عادلانه را تشکیل میدهد. این اصل، تلاشی در جهت کاستن قدرت اختیارات حکومت در حد یک نظام اصولی و قانونمند بوده، و تضمینی بر عدم محرومیت انسان از حیات، آزادی و مالکیت میباشد. بنابراین، اصل لزوم رعایت تشریفات قانونی و عادلانه، بیآنکه اختصاصی به محاکمۀ عادلانه یا استقلال قضایی داشته باشد، مجموعۀ حکومت را خطاب قرار داده و از این قرار، اقدامات خارج از حدود اختیارات بخش اجرایی حکومت و نیز وضع قوانین و مقررات غیراصولی یا غیر قانونمند از سوی قانونگذاران را ممنوع و بیاعتبار میسازد.
Field and Aims: Today, the most important criteria for defining the principle of "need to observe legal and fair procedures" is to protect the human person against the arbitrary behavior of governments, and against the arbitrary suspension of fundamental human rights and freedoms. Failure to comply with the principles of necessity and proportionality, which is required by this principle, especially during criminal trials, causes the international responsibility of governments.
Method: The present research was carried out with a descriptive analytical method.
Finding and Conclusion: The right to access to an impartial and independent court, the right to a speedy trial, the principle of acquittal, etc. are among the rights that, along with the rule of law and judicial independence, are closely linked with other elements, especially "democracy". And "legality" constitutes the content of the principle of the necessity of observing legal and fair procedures. This principle is an attempt to reduce the authority of the government to the level of a principled and legal system, and it is a guarantee that human beings are not deprived of life, freedom and property. Therefore, the principle of the necessity of observing legal and fair procedures, without being specific to a fair trial or judicial independence, is addressed to the whole of the government, and therefore, actions outside the scope of the powers of the executive branch of the government, as well as the imposition of unprincipled laws and regulations or invalidated by the legislators.
