خلاصة:
چندین دهه است دغدغه اسلامی سازی علوم انسانی ذهن و ضمیر متولیان فرهنگی کشور را مشغول نموده است. در بین علوم انسانی علوم وارداتی همچون روانشناسی که خاستگاه غربی دارند برای بحث اسلامیسازی مورد توجه قرار گرفتهاند و براساس یک تلقی سطحی، با توجه به اینکه قوانین اصلی همچون قانون مدنی،از فقه اقتباس شده اند، در عرصه علم حقوق با چالش اسلامیسازی روبرو نیستیم. این تصور به دلایل متعددی نادرست است. ما در عرصه حقوق در دو عرصه تقنین و تفسیر با چالش روبرو هستیم. در عرصه تقنین وجود قوانینی که مربوط به قبل از انقلاب بوده و مشروعیت آنها ممیزی نشده است، از چالشهای اساسی است و چالش مهمتر دیگر، نظام تفسیر قوانین می باشد. وجود برخی گزارههای دینی و حتی وضع قانون مبتنی بر مبانی اسلامی، برای شکل گیری علمِ حقوقِ اسلامی کافی نیست وآنچه مهم است نگاه و شیوهی تفسیر وتوسعهی این گزارهها بر اساس مبانی اسلامی میباشد. در این تحقیق بر اساس روش توصیفی_ تحلیلی از زاویه فقه اسلامی به نقد علم حقوق کنونی با تاکید برحقوق مدنی به عنوان یکی از شاخههای اصلی علم حقوق، در دو حوزه تقنین و تفسیر، پرداختهایم.
It has been several decades since the concern of Islamization and localization of humanities has occupied the mind and conscience of the country's cultural custodians. Among the humanities, mostly imported sciences such as psychology and sociology, which have western origins, have been considered for localization and Islamization discussion. Based on a superficial conception, considering that the primary Codes, such as the Civil Code and the Islamic Penal Code, are adapted from jurisprudence, we are not facing the challenge of Islamization in legal science. This conception is incorrect for multiple reasons. In the field of law, we face challenges in the two domains of legislation and interpretation. In the area of legislation, one of the fundamental challenges is the existence of a vast volume of laws related to the time before the revolution in which legitimacy has not been audited, and the more important challenge is related to the interpretation system. The existence of some religious propositions and even the establishment of laws based on Islamic principles are not enough for forming Islamic legal science, and the importance lies in the viewpoint and method of interpreting and developing these propositions based on Islamic principles.
