بهکارگیری قاعده «مسئولیت ناشی از فعل غیر» در رسیدگی به دعاوی قصور پزشکی واجد مزایای متعددی از جمله ارتقای نظارت مدیران بر کارکنان در مراکز بهداشتی درمانی، تأمین بهتر اهداف عدالت ترمیمی، تسهیل رسیدگیهای قضایی و کارشناسی و کاهش رویکرد تدافعی در شاغلان حِرَف پزشکی است. هدف بررسی حاضر، امکانسنجی بهکارگیری این قاعده حقوقی در رسیدگی به دعاوی قصور پزشکی با نگاهی به رویکرد سازمانهای پزشکی قانونی و نظام پزشکی مشهد در کاربرد این قاعده در صدور نظریات کارشناسی بود. در این مطالعه پس از بررسی جایگاه مسئولیت ناشی از فعل غیر در فقه و حقوق موضوعه و حقوق تطبیقی، امکان تعمیم معیارهای حاکم بر مسئولیت ناشی از فعل غیر بر روابط بین شغلی گروه پزشکی بررسی شد و رویکرد موجود سازمانهای پزشکی قانونی و نظام پزشکی مشهد در این خصوص با رجوع به نمونههایی از نظرات کارشناسی آنان مورد ارزیابی قرار گرفت. بر این اساس مشخص شد قاعده «مسئولیت ناشی از فعل غیر» در برخی پروندههای قصور پزشکی با در نظر گرفتن نوع رابطه بین اشخاصِ دخیل در پرونده، تاکنون در نظرات کارشناسی سازمانهای پزشکی قانونی و نظام پزشکی مشهد در ۳ حالت زیر بهکار گرفته شده است: ۱- قابلیت انتساب قصور اشخاص به فقدان نظارت کافی از جانب مسئولان مافوق ۲- محول کردن انجام اموری که در حوزه وظایف شخص است به دیگری که صلاحیت انجام مستقل آن امر را ندارد ۳- در شرایطی که مباشرِ عملِ سهلانگارانه، یک فردِ نامشخص از بین چند نفر است که همه آنان کارکنان یک کارفرما هستند. آشنایی قضات، حقوقدانان و کارشناسان پزشکی با معیارهای بهکارگیری قاعده «مسئولیت ناشی از فعل غیر» در حوزه پزشکی، نهتنها میتواند موجب تسهیل و تسریع رسیدگی عادلانه به پروندههای قصور پزشکی شود، بلکه میتواند با کاستن از گرایش کارکنان نظام سلامت به رویکرد پزشکی تدافعی و افزایش میزان نظارت مسئولان بر عملکرد کادر درمان، ساختار نظام سلامت را در ارتقای سطح ارائه خدمات خود یاری رساند.
Applying the rule of "liability for the acts of others" in the handling of medical malpractice lawsuits has many advantages, including improving the level of supervision of managers over employees in the healthcare system, better achieving the goals of restorative justice, facilitating judicial and expert proceedings, and reducing the defensive approaches in employees. The purpose of the present study was to investigate the feasibility of applying this legal rule in handling medical malpractice lawsuits by looking at the approaches of Mashhad Legal Medicine Organizations and Mashhad Medical Council in applying this rule in issuing expert opinions. After examining the position of liability for the acts of others in jurisprudence, subject law and comparative law, the possibility of generalizing the criteria governing liability for the acts of others to inter-occupational relationships in the medical field was examined and the existing approach of Mashhad Legal Medicine organization and Mashhad Medical Council, Iran were evaluated in this regard by referring to samples of their expert opinions. It was determined that the rule of "liability for the acts of others" has been used in the medical expert opinions of Mashhad in three situations: 1. The ability to attribute the negligence of individuals to the lack of sufficient supervision by superior officials. 2. Assigning the performance of tasks that are within the scope of a person's duties to someone else who does not have the competence to perform that task independently. 3. In a situation where the person in charge of the negligent act is an unknown person among several people, all of whom are employees of the same employer. Applying the rule of "liability for the acts of others" in the medical field, can help the judicial system to improve the level of justice achievement because of its several advantages.
