تأثیر فوت متعهد بر بقای تعهد مقالة

در نظام حقوقی رومی ژرمنی، نظر به تحلیل تعهد به رابطه میان متعهد و متعهدٌله، برای مدت‌ها با فوت متعهد رابطه حقوقی تعهد ازمیان می‌رفت. به‌تدریج برای اطمینان از بقاء تعهد، بر بنیاد عقل‌گرایی غیرفلسفی و به مدد اعتبار نظریه قائم مقامی بود که مشکل مزبور برطرف شد. این نتیجه مورد متابعت قانون مدنی و تأیید حقوقدانان داخلی نیز قرار گرفته است. نوشتار حاضر به دنبال پاسخ انتقادی به این پرسش است که آیا ازنظر فقهی با فوت متعهد، تعهد ازمیان می‌رود؟ آیا بر بنیاد فقه امامیه می‌توان با ابتناء بر نظریه قائم‌مقامی، حکم به بقا تعهد پس از فوت نمود؟ به‌باور نگارندگان، شناسایی پاسخ، فرع بر تحلیل ماهیت تعهد و همچنین امکان‌سنجی بقای عهده پس از فوت است. تعهد نه رابطه اعتباری میان متعهدٌله و مال، بلکه رابطه اعتباری میان دو شخص است. در این میان معیار تشخیص این دو از اهمیت برخوردار است. درنتیجه تعهد، بر عهده متعهد «تکلیف» و برای متعهدٌله «حق مطالبه» ایجاد می‌شود. حسب قواعد، با فوت مخاطب، تکلیف و همچنین عهده او که محل استقرار تکلیف است، ساقط می‌شود و امکان انتقال آن به ورثه و قائم‌مقامی آنها وجود ندارد. شایان ‌ذکر است نظر به تملیکی‌بودن غالب موجبات حقوقی در فقه، فقها نیاز چندانی به نظریه قائم‌مقامی احساس ننموده‌اند.

This article answers this question that if obligation extinguishes after the obligor’s death in jurisprudence view? On the Shia jurisprudence foundation, considering subrogation theory, can we say that obligation continues after the obligor’s death? It depends on considering the nature of obligation and also feasibility of the container of duty continuance after death. Obligation is not the constructional relationship between obligee and goods, but it is the constructional relationship between two people. The distinguishing standard is important. As the result of obligation, duty is for obligor and the right of demanding is for the obligee. According to the rules, by obligor’s death, the duty and also the container of the duty extinguish and it is impossible to transfer it to the heirs or take them as subrogates. The most of the legal relationships are possessory in jurisprudence and Shia jurisprudents did not use the theory of subrogation.
