خلاصة:
زمینه و هدف: هدف این مقاله بررسی راهکارهای موجود در فقه امامیه و به تبع آن قوانین کیفری جمهوری اسلامی ایران برای محدود کردن دامنه این مجازات سنگین و بیبازگشت برای حفظ جان انسانها و تداوم و تعالی عینی حقوق بشر در کشور عزیزمان ایران اسلامی است.
مواد و روشها: مقاله توصیفی تحلیلی بوده و از روش کتابخانهای استفاده شده است.
ملاحظات اخلاقی: در این تحقیق، اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: در گذشته دور اعدام کیفری نسبتاً مرسوم و متعارف در میان جوامع بشری به حساب میآمد. امروزه با همهگیری حقوق بشر و احترام به نفس انسانی و لزوم صیانت از آن در برابر دست تطاول قدرتها این مجازات در بسیاری از کشورهای کره خاکی برچیده شده و در بقیه کشورها نیز به شدت کاهش یافته و محدود شده است. بدین جهت سه دسته مجازات با عناوین حدود، قصاص و تعزیرات مورد بحث قرار گرفته راهکارهای موجود در هر یک برای نیل به هدف پیش گفته، بررسی شده است.
نتیجهگیری: در احکام برآمده از فقه جزایی شیعه و به تبع آن مفاد قوانین کیفری مصوب و حاکم بر جمهوری اسلامی ایران، مکرراً به مجازات اعدام به عنوان سنگینترین نوع مجازاتها بر میخوریم. در میان مجازاتهای چهارگانه مندرج در قانون مجازات اسلامی مصوب 1392 مجازات اعدام میتواند سه دسته تعزیرات، حدود و قصاص نفس باشد.
Background and Aim: The present paper aimed to study effective solutions available in the Imamiyeh jurisprudence and the Iranian criminal law to decrease the execution of death penalty in Iran to not only save human lives but also realize human rights in Iran.
Materials and Methods: The library method was used to conduct this descriptive-analytical research.
Ethical Considerations: Originality of texts, honesty and confidentiality were preserved in this paper.
Findings: The execution of death penalty was almost common in the past. However, with regard to the necessity of respecting for human rights and lives against violence, the execution of death penalty is now forbidden in many parts of the world or has been decreased to a great extent. Therefore, the present paper have dealt with three types of punishments, namely definite punishment, retaliation, and discretionary punishment, in order to find effective solutions to achieve the foregoing goal.
Conclusion: According to the Shiite criminal jurisprudence and the Iranian criminal law, the death penalty proved to be the most severe punishment among others. With regard to quadruple punishments introduced in the Islamic criminal law (2013), death penalty falls into three categories including definite punishment, retaliation, and discretionary punishment.
