خلاصة:
جای پای بلاکچین و انواع دارائیهای رمزنگاری شده در بخشهای مختلف اقتصاد و تجارت بینالملل مشهود است. این نقش پر رنگ و قابلیت جریان سازی آن میتواند بسیاری از مقررات پیشین را به چالش بکشد و کاستی و عدم کارائی مقررات موجود را نمایان سازد. بررسی عواملی که موجب ورود چنین تکنولوژی در حوزه اقتصاد و تجارت بینالملل میگردد، ضرورت وجود مقرراتی هماهنگ با ظهور این تکنولوژی و تغییرات حال و آینده تجارت بینالملل را نشان میدهد. عواملی مانند مبادله جهانی این دارائیها، استفاده از آن به عنوان وسیله نوین پرداختهای بینالمللی یا به عنوان ابزاری برای تامین مالی و سرمایه گذاری و کارکرد آن برای اعمال مالکیت جهانی موجب لزوم نگاهی بینالمللی به این تکنولوژی خواهد بود. از طرفی دیگر این موضوع جزء مواردی است که آثار و تبعات آن میتواند به خارج از مرزهای ملی کشیده شود و در چنین موضوعاتی نیاز به یکسانسازی قوانین و مقررات ملی است. حال آنکه کشورها به عنوان بازیگران عمده بینالمللی در مقرراتگذاری آن رویکرد یکسانی ندارند، برخی به دنبال محدودیت و ممنوعیت دارائیهای رمزنگاریشده بودهاند، برخی با بلاتکلیفی قانونی رو در رو هستند و برخی دیگر به سمت پذیرش و نیل به قانونگذاری مثبت حرکت کردهاند. تفاوت رویکرد کشورها نشان میدهد که مقررات ملی به تنهایی قادر به ایجاد نظم و انضباط این مقوله جهانی نیست. پس در چنین موضوعاتی حتماً باید از طریق وضع مقررات یکسان و هماهنگ با دیگر کشورها به دنبال نظم و انضباط بینالمللی رفت.
The Necessity of International Regulation of Blockchain and Crypto Assets Hadi VAHID (Associate Professor of Law, Shahid Behshti University) Behrad SAGHIRI (Ph.D. Candidate of International Commercial Law, Shahid Beheshti University) Abstract The footprint of block chain and all types of crypto assets is evident in various sectors of the economy and international commerce. This various role and its streaming capability can challenge many of the previous regulations and show the inadequacy and inefficiency of the existing regulations. Examining the factors that cause the entry of such technology in the field of economy and international commerce shows the necessity of having regulations in harmony with the emergence of this technology and the current and future changes in international commerce. Factors such as the global trades of these assets, their use as a new tool of international payments or as a tool for financing and investment, and their function to apply global ownership will necessitate an international look at this technology. Beside, this issue is one of the cases whose effects and consequences can be extended beyond the national borders, and in such cases, there is a need to unify national laws and regulations. The difference in countries' approaches shows that national regulations alone are not able to create order and discipline in this global category. Therefore, in such matters, it is necessary to seek international order and discipline through the establishment of uniform and coordinated regulations with other countries.
