تأثیر و نقش حقوق اساسی در تضمین حقوق شهروندی مقالة

حقوق شهروندی یکی از مبانی فکری دموکراسی و مفاهیم اساسی زندگی دموکراتیک به شمار می‌رود. شهروندی مقوله‌ای است که با مفهوم فرهنگ هر جامعه گره خورده و فرهنگ هر مرزوبوم ناشی از سه قلمرو اساسی فعالیت‌های اجتماعی، فضای سیاسی و وضعیت اقتصادی آن جامعه است. در یک جامعه مدنی حقوق یک فرد عبارتند از: حقوق اساسی به معنی حقوق بنیادی شهروندان یک جامعه، حقوق سیاسی به معنای حق مشارکت در فرایندهای سیاسی، حقوق اجتماعی که دربرگیرنده حقوق اقتصادی و نیز حداقل‌های استانداردهای زندگی در تسهیلات اجتماعی است. میزان رعایت‌ و اهتمام به‌ حقوق شهروندی در هر کشوری را با مقیاس مجالس‌ قانونگذاری و سایر ارکان قانونگذاری می‌توان سنجید. در این راستا حقوق شهروندی به‌ عنوان یکی‌ از بدیهی‌‌ترین‌ حقوق فردی و گروهی‌ سهم‌ به سزایی‌ در احساس عدالت‌ اجتماعی‌ را دارا می‌‌باشد، به طوری که‌ میزان رعایت‌ حقوق شهروندی در جامعه‌ ملاک و معیار مناسبی‌ جهت‌ سنجش‌ نابرابری‌های اجتماعی‌، سیاسی‌، اقتصادی و فرهنگی‌ محسوب می‌‌شود. به‌ طور کلی‌ احترام به‌ حقوق شهروندی و رعایت‌ و تضمین‌ آن در یک‌ جامعه‌ به‌ دور از رنگ‌ و زبان و نژاد و قومیت‌ و مذهب‌ همواره مورد تأکید قرار گرفته،‌ علی‌‌الخصوص در جامعه‌ اسلامی‌ ایران که‌ مبنا و پایه‌‌های آن بر طبق‌ موازین‌ اسلام نهاده شده و امروزه حقوق شهروندی و توجه‌ به‌ حقوق سیاسی‌ و مدنی‌، حقوق و آزادی‌های اقتصادی، اجتماعی‌، فرهنگی‌ و حقوق قضائی‌ افراد جامعه‌ یکی‌ از عناصر تفکیک‌ ناپذیر هر قانون اساسی‌ بوده و لزوم توجه‌ و صیانت‌ از حقوق شهروندی در اصول متعدد فصل‌ پنجم‌ قانون اساسی‌ جمهوری به‌ صراحت‌ آمده است‌. بنابراین معنای اصلی‌ حقوق شهروندی رعایت‌ و حفظ‌ حقوق افراد و انسان‌ها در بخش‌ کلان جامعه‌ است‌ و شهروندان باید از همه‌ حقوق ازجمله‌ حقوق سیاسی‌ و مدنی،‌ حقوق قضایی، حقوق اقتصادی و رفاهی برخوردار باشند.

Citizenship rights are one of the intellectual foundations of democracy and the basic concepts of democratic life. Citizenship is a category that is tied to the concept of the culture of each society and the culture of each border and environment is derived from the three basic realms of social activities, the political environment and the economic status of that society. In a civil society, the rights of an individual include: fundamental rights, meaning the fundamental rights of the citizens of a society, political rights, meaning the right to participate in political processes, social rights, which include economic rights and minimum standards of living in social facilities. The degree of observance and attention to citizen's rights in any country can be measured by the scale of legislative assemblies and other legislative bodies. In this regard, citizenship rights, as one of the most obvious individual and group rights, has a significant contribution to the feeling of social justice, so that the degree of observance of citizenship rights in the society is considered a suitable criterion for measuring social, political, economic and cultural inequalities. In general, respect for the rights of citizens and their observance and guarantee in a society far from color, language, race, ethnicity and religion have always been emphasized, especially in the Islamic society of Iran, whose foundations are laid according to the standards of Islam. Today, citizenship rights and attention to political and civil rights, economic, social, and cultural rights and freedoms, judicial rights of members of the society are one of the inseparable elements of every constitution, and the need to pay attention and protect citizenship rights in the numerous principles of the fifth chapter (Laws nation) the constitution of the republic is clearly stated. Therefore, the main meaning of citizenship rights is to observe and preserve the rights of individuals and human beings in the larger part of society, and citizens should enjoy all rights, including political and civil rights, judicial rights, economic and welfare rights.

به طور کلي احترام به حقوق شهروندي و رعايت و تضمين آن در يک جامعه به دور از رنگ و زبان و نژاد و قوميت و مذهب همواره مورد تأکيد قرار گرفته ، علي الخصوص در جامعه اسلامي ايران که مبنا و پايه هاي آن بر طبق موازين اسلام نهاده شده و امروزه حقوق شهروندي و توجه به حقوق سياسي و مدني ، حقوق و آزادي هاي اقتصادي ، اجتماعي ، فرهنگي و حقوق قضائي افراد جامعه يکي از عناصر تفکيک ناپذير هر قانون اساسي بوده و لزوم توجه و صيانت از حقوق شهروندي در اصول متعدد فصل پنجم قانون اساسي جمهوري به صراحت آمده است . قانون اساسي جمهوري اسلامي ايران در فصل سوم به حقوق ملت پرداخته و مهم ترين حقوق شهروندي که قانون اساسي مقرر نموده است عبارتند از: برخورداري از حقوق مساوي ؛ اصل امنيت فردي ؛ اصل مصونيت مسکن و محل سکونت ؛ اصل عدم تعرض به مکاتبات ؛ اصل ممنوعيت تفتيش عقايد؛ اصل حقوق قضايي شهروندي ؛ اصل برائت ؛ اصل آزادي اخبار و اطلاعات ؛ اصل آزاديهاي سياسي و اجتماعي ؛ اصل حرمت مالکيت ؛ حق تابعيت و تغيير آن. همچنين حق انتخاب وکيل براي طرفين دعوا در همه دادگاه ها در اصل سي و پنجم قانون اساسي پيش بيني شده و اين حق نيز مهم و مکمل حقوق قضايي شهروندي است .
