خلاصة:
سیاست جنایی در مفهوم موسع و حقوقی – اجتماعی خود در مقابل مفهوم مضیق و معادل (سیاست کیفری) در دهههای اخیر مطرح و کموبیش در کشورهای اروپای قارهای بهعنوان یک نظم نوین مورد قرارگرفته است. ازجمله مطالعاتی که در این قلمرو بهعملآمده عبارت است از اینکه، این مقوله، با بذلتوجه به (عناصر نامتغیر) موجود در هر سیاست جنایی (جرم -انحراف و پاسخ دولتی – پاسخ اجتماعی) و (روابط) اساسی و فرعی موجود بین این عناصر، (تحلیل ساختاری) و (مدل بندی) شده است. در این روش بررسی، (جرم) بهعنوان نقض هنجارهای لازم الاتباع غالباً حقوقی (نرماتیویته – باید بودن) و (انحراف) بهعنوان نقض هنجارهای غالب اجتماعی یا حالت عدم تطابق با میانگین رفتاری (نرمالیته – وضعیت غالب موجود رفتاری) تعریفشده است. با توجه به فراگیر بودن هنجارهای حقوقی (احکام خمسه تکلیفیه) در اسلام، برای مطالعه سیاست جنایی در ایران به تقسیم رفتارهای ناقض هنجار به (جرم) و (انحراف) – در مفاهیم یادشده چندان عملی نیست. بااینوجود، در نظام هنجاری اسلام رفتارهای کنترلشده از رفتارهای آزاد متمایز میباشند.
Criminal policy in its broad and legal-social concept (as opposed to the narrow and equivalent concept (penal policy)) has been proposed in recent decades and has been more or less considered as a new order in the countries of continental Europe. Considering the pervasiveness of legal norms (the rules of obligatory khumsah tavariyyah) in Islam, for the study of criminal policy in Iran, dividing the behavior that violates the norm into (crime) and (deviance) - in the aforementioned concepts It is not practical.
