خلاصة:
«اهداء عضو» هم در پزشکی و هم در فقه اسلامی مهم است زیرا از طرفی ملازم با قطع اعضاء و تصرف در تمامیت جسمی فرد، و حرمت اضرار به نفس و حرمت قطع اعضای میت و بحثهای پیرامونی دیه و قصاص است؛ و از طرف دیگر با هدف حفظ حیات و رهایی انسان از درد و رنج قرین است. نوشتار حاضر پاسخی تحلیلی است به این سؤال که، حکم «اهداء اعضای انسان مسلمان از دیدگاه فقهی چگونه است؟» اهدای عضو به معنای موافقت برای برداشتن اعضاء، بافتها و نسوج از بدن است. زمانی که مرگ مغزی فرد اهداء کننده اعلام و تایید شود، اهداء عضو در صورت رضایت متوفی در زمان حیات انجام میگیرد. از نظر فقهی اگر اهدای عضو منجر به مرگ دهنده عضو باشد جایز نیست. اما در مورد کسی که بعد از اهدای عضو زنده میماند مانند اهدای یک کلیه، از آنجا که فرد پس از این اهداء ممکن است در زندگی با مشکل مواجه شود بعضی فقها فتوای جواز ندادهاند اما برخی دیگر بر اساس آیه 9 سوره حشرفتوای به جواز داده اند. اگرچه فتوای علمای اعلام تا به امروز مورد بحث وبررسی قرار گرفت ولی باب اجتهاد در این زمینه همچنان مفتوح است.
Organ donation is important both in medicine and in Islamic jurisprudence, because it involves mutilations, the seizure of physical integrity of the individual, the prohibition of self-destruction and mutilation of dead body and other discussions about atonement and punishment; and moreover, it is accompanied by the aim of saving life and liberating human from pain and suffering. The present paper is an analytical answer to this question that “what is the verdict of organ donation of a Muslim from jurisprudential point of view?”, organ donation means consenting to remove organs and tissues. When the donor's brain death is declared and approved, the donation is made providing the consent of deceased at the time of life. From the jurisprudential point of view, organ donation is not permissible if it leads to the death of donor. In the case of someone who survives after a donation, such as the donation of one kidney, since a person may face with difficulty in life after the donation, some jurists have not allowed it; however, others allowed it according to verse 9 of the surah Al-Hashr. Although the verdicts of scholars have been discussed up to now, this matter can still be interpreted.
