خلاصة:
مقدمه و هدف: کاربرد گسترده الکل و فراوردههای الکلی سبب شده که به یکی از مسایل چالشی برای مردم و علوم پزشکی تبدیل گردد که نیازمند بررسی ماهیت فقهی الکل است. از نظر فقهی، هر چیز مُسکر(مستیآور) نجس و حرام است. اما مسأله مسکر بودن الکل (نجاست و حرمت الکل) در بین فقها مسألهای اختلافی است. هر چند بخشی از این اختلاف، ناشی از تفاوت در مبانی فقهی است و گریزناپذیر است؛ اما برخی دیگر، به دلیل شناخت ناکافی نسبت به ماهیت الکل میباشد. در این تحقیق تلاش شده ماهیت الکل از منظر موضوعشناسی فقهی تبیین شده و ارتباط آن با دو مفهوم «خمر» و «مسکر» مورد بحث و بررسی قرار گیرد. مواد و روشها: روش مطالعه در این پژوهش، توصیفی ـ تحلیلی است که با مراجعه به متون دینی و علمی انجام شده است و اطلاعات بهدستآمده دستهبندی و مورد تجزیه و تحلیل قرارگرفته است. یافتهها: الکل از موضوع ادله شرعی «خمر» و «مسکر» خارج میباشد و مصداق هیچیک از مفاهیم شرعی «خمر» یا «مسکر» قرار نمیگیرد.
Background and aim: The numerous uses of "alcohol and alcoholic products" have caused it one of the issues facing people and medical sciences, which requires jurisprudential review. From the jurisprudential point of view, everything that is intoxicating is Najis and Haram. But the issue of iscar or lack of iscar of alcohol is a matter of dispute among Shi'a jurisprudents. Although some of this disagreement stems from the differences of jurisprudential principles and is inevitable, others are due to insufficient knowledge of the nature of alcohol. In this research, it has been attempted to explain the nature of alcohols from the jurisprudential theological point of view and its relation to the two jurisprudential titles of "Khamr" and "Mosker". Methods: The method of study in this research is descriptive and analytical, which is done by referring to religious and scientific texts and the information obtained is categorized and analyzed. Findings: alcohol is out of the question of religious evidence of Khamr and Mosker and they do not apply to any of the religious concepts of "khamr" or "Mosker".
