مقدمه: شناسایی و اجرای احکام صادره در خصوص دعاوی خانوادگی، به لحاظ ارتباط بسیاری از آنها با نظم عمومی و اخلاق حسنه داخلی، از اهمیت بسیار برخوردار است. مواد و روش ها: این تحقیق یک روش کتابخانه ای است. یافته ها: در شناسایی و اجرای احکام خانوادگی علاوه بر شرایط مقرر در قانون مدنی و قانون اجرای احکام مدنی، عناصری مانند تابعیت، اقامتگاه زوجین، رابطهی زوجیت و ابوینی و دین طرفین دعوی نقش بسزایی دارد. تحلیل ها حاکی از آن است که قانونگذار با واگذاری اجرای این دسته از احکام به عمومات اجرای احکام مدنی، و همچنین لزوم کاوش مقام قضایی در قواعد حل تعارض، ابهامات قابل توجهی را در این خصوص باقی گذاشته است. در حالی که قانون حمایت از خانواده 1390، صرفا به جرم ارتکابی توسط سردفتر بدون وجود احکام تفیذی، تنها بُعد بسیار کوچکی از شناسایی و اجرای این احکام را مدنظر قرار داده است. نتیجه گیری: در برخورد با احکام صادره در دعاوی خانوادگی قضات، باید افزون بر به کارگیری نظام کنترل محدود، عناصری چون تابعیت هر یک از اصحاب دعوا، رابطه ی زوجیتی و یا ابوینی آنها را نیز لحاظ کنند. از این رو، رفع ابهام از قوانین موجود و افزایش سطح آگاهی قضات، نسبت به چگونگی برخورد با اینگونه احکام ضروری است

Finding: In identifying and enforcing family judgments, in addition to the conditions set forth in the Civil Code and the Civil Judgments Enforcement Law, elements such as citizenship, the couple's residence, the marital-parental relationship, and the religion of the parties to the lawsuit play an important role. Analyzes indicate that the legislature has left significant ambiguities in this regard by delegating the enforcement of this category of judgments to the general enforcement of civil judgments, as well as the need for the judiciary to explore conflict resolution rules. However, the Family Protection Act of 2011, only for the crime committed by the notary public without the existence of enforceable sentences, has considered only a very small dimension of identification and implementation of these sentences.
Conclusion: In dealing with rulings in family litigation, judges should consider elements such as the nationality of each of the litigants, their marital or parental relationship, in addition to applying a limited control system; This has been challenging in some cases; Therefore, it is necessary to remove the ambiguity of the existing laws and increase the level of awareness of judges on how to deal with such rulings.
