برابر نبودن دیه زن و مرد از موضوعات بحثبرانگیز در جوامعی است که مدعی رعایت حقوق بشر هستند. در فقه اسلامی و بر مبنای فتوای مشهور فقها، دیه زن نصف دیه مرد است و در جراحات هم عقیده براین است که زن و مرد تا یکسوم دیه مساویاند و بیش از آن، دیه زن نصف میگردد. در مقابل، گروهی از فقهای امامیه و حنفیه برخلاف مشهور، معتقدند که در دیه زن و مرد تفاوتی نیست. این گروه برای اثبات دیدگاه خود به اطلاق آیات قرآنی و روایات متعدد دال بر برابری اسـتناد کردهاند. با توجه به اهمیت مساله، در این مقاله ضمن بیان تحولات تاریخی نظام دیه و تعریف دیه از دیدگاه فقهای امامیه و حنفیه، ماهیت دیه و ادله طرفین مورد بحث و تجزیه و تحلیل و نقادی قرارگرفتهاند. در این تحقیق از روش توصیفی تحلیلی استفاده شده است و دادهها به شیوه کتابخانه ای جمع آوری گردیده اند.
Inequality of dowry between men and women is a controversial issue in societies that claim to respect human rights. In Islamic jurisprudence and based on the famous fatwas of jurists, the woman's dowry is half of the man's dowry, and in injuries, it is the same opinion that men and women are equal up to one-third of the dowry, and more than that, the woman's dowry is halved. On the other hand, a group of Imamiyyah and Hanafiyyah jurists, contrary to popular opinion, believe that there is no difference in money between men and women. To prove their point of view, this group has referred to the Qur'anic verses and numerous traditions indicating equality. Considering the importance of the issue, in this article, in addition to stating the historical developments of the Diya system and the definition of Diya from the perspective of Imamiyyah and Hanafi jurists, the nature of Diya and the arguments of the parties have been discussed, analyzed and criticized. In this research, a descriptive analytical method has been used and the data has been collected in a library manner.
