برخلاف باور موجود که بسترحقوق تجارت بین الملل را نظم نوین بین المللی وستفالیایی ناظر بر دولت های تعریف شده در مرزهای حاکمیتی می داند،درعصر حاضر ما در بحبوحه یک تحول عمیق سیستمی و گذار به نظم جهانی پساوستفالیایی هستیم که با تعریف مجدد مرز و جغرافیا، دگرگونی مفهوم اقتدار سیاسی و تمایز گسترده بین حوزه‌های عمومی و خصوصی به منصه ظهور میرسد. ظهور یک نظم تراملی پیامدهای مهمی برای شرکتهای چند ملیتی از نظر عمق دخالت آنها در سیاست بین المللی و نحوه تدوین استراتژی خواهد داشت.. جایی که شرکتهای چند ملیتی جایگاه مرکزی دارند .جایگاه شرکت های چند ملیتی در این برهه تغییر یافته و نه تنها تابع این نظم حقوقی نوین قلمداد میشود بلکه در فرایند تشکیل آن نقش خواهد داشت.پژوهش حاضر به بررسی جایگاه این شرکتها در نظم حقوقی تراملی و مشارکت رو به رشد این شرکت های در حاکمیت جهانی به عنوان موضوع و واضع حقوق بین الملل می پردازد. در این پژوهش ابتدا به چالش‌های نظم پسا وستفالیایی و پیامدهای آن برای رفتار فعلی شرکتهای چندملیتی اشاره نموده و در ادامه نقش بازیگران خصوصی در حکمرانی جهانی در پرتو حقوق تراملی را مرور کرده و چالش های تنظیم مقررات برای شرکت های چندملیتی مورد بحث قرار می دهیم. مفروض است که این تحولات نشان‌دهنده یک تغییر پارادایم در حال ظهور است که به اندیشه نگارنده نظم نوین حقوقی تراملی است.
