خلاصة:
زمینه و هدف: داوری دارای مزیت های متعددی است؛ اما شناسایی و اجرای آرای خارجی در دعاوی تجاری بین‌المللی از مسائل و چالش‌های آن است. هدف مقاله حاضر بررسی شناسایی آرای داوری تجاری بین‌المللی در حقوق ایران و کنوانسیون نیویورک است. مواد و روش‌ها: روش تحقیق در مقاله حاضر توصیفی-تحلیلی و مواد و داده‌ها کیفی است. از فیش‌برداری در گردآوری مطالب و داده‌ها استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متن، صداقت و امانت‌داری رعایت شده است. یافته‌ها: یافته‌ها نشان داد در حقوق داوری ایران، شرایط شناسایی آرای داوری بررسی نشده است و قانون‌گذار در این خصوص سکوت کرده است. در کنوانسیون داوری نیویورک شرایط شناسایی رأی داوری مشخص شده است که مطابق آن نیازی به مراجعه به دادگاه کشور محل اجرای داوری نیست. در حقوق داوری ایران موانع شناسایی و اجرای داوری مطرح شده است که در مواردی چون نظم عمومی، وجود موافقت‌نامه داوری، دادرسی منصفانه، انجام تشریفات داوری و عدم عدول داور از اختیارات داوری با شرایط کنوانسیون داوری نیویورک مشابهت دارد. با وجود این، برخی از این موانع مورد اشاره مانند نظم عمومی در حقوق ایران با ابهام مواجه است و با آنچه زیر عنوان نظم عمومی در کنوانسیون نیویورک مطرح است متفاوت است. همچنین شرایطی که در ماده 139 قانون اساسی ایران مطرح شده است، شناسایی و اجرای رأی داوری تجاری بین‌المللی را با مشکل مواجه می‌کند.
Background and Aims: The purpose of this article is to examine the identification of international commercial arbitration awards in Iranian law and the New York Convention. Materials and methods: This article is descriptive and analytical. The materials and data are also qualitative and data collection has been used. Ethical considerations: In the present paper, the originality of the text, honesty and trustworthiness are respected. Results: The findings showed that in Iranian arbitration law, the conditions of recognition of arbitration opinions have not been addressed and the legislator has remained silent in this regard. In the New York Arbitration Convention, the conditions for recognition of the arbitration award have been specified, according to which there is no need to go to the court of the country where the arbitration is performed. In Iran's arbitration law, there are obstacles to recognition and implementation of arbitration, which are similar to the terms of the New York Arbitration Convention in cases such as public order, existence of arbitration agreement, fair trial, performance of arbitration formalities, and non-derogation of arbitrator's powers of arbitration. However, some of these mentioned obstacles, such as public order in Iran's laws, have been faced with problems and are different from what is mentioned under the title of public order in the New York Convention.
