خلاصة:
تهدف هذه الدراسة إلی طرح التساؤل حول الکیفیة التی یمکن من خلالا أن یشکل القانون ال حتائی الوطنی آلیة فاعلة لإتفاذ أحکام القانون الدوی الإنسانی. ولعل طرح مثل هذا التساؤل أصبح یمثل ضرورة ملحة بالنسبة لنا نحن العرب، لاسیما و أن سعی المجتمع الدولی إلی تحقیق الملاحقة القضائیة مرتکبی الجحرائم والانتهاکات الخاصة بالقانون الدولی الإنسانی أمام الجهاز القضائی الدائم المتمثل فی المحکمة الحنائیة الدولیة فی لاهای یواجه دائاً عقبات من قبل بعض الدول، التی تسعی دائاً إلی أن تتهرب من التزاماتها الدولیة. فغالباً ما ترفض هذه الدول التصدیق علی النظام الأسامی ذه المحکمة، وأحیاناً تقید عملها من خلال اتفاقیات ثنائیة نع حاکمة مواطنیها أمامهاء وأحیاناً أخری تدفع المجتمع الدولی إلی التغافل عن تلک الانتهاکات للقانون الدولی الإنسانی من خلال عرقلة اتغاذ إجراءات الإحالة من قبل مجلس الأمن التی یسمح با النظام الأساسی للمحکمة الجنائیة الدولیة. ولعل الحرب الأخبرة علی غزة خیر مثال یکشف عن ذلک الأمر. وعلی هذا فلابد من تفعیل دور القانون الجنائی الوطنی» من خلال القیام بعملیة إدماج تشریعی للجرائم الدولیة - ولاسی انتهاکات القانون الدولی الإنسانی - ضمن التشریعات الوطنیة. فعبر (الاستثمار) فی القانون الجحنائی الوطنی» یمکن أن تصبح الملاحقة الفاعلة حرائم القانون الدولی الإنسانیء سواءً المرتکبة فی محیطنا الإقلیمی أو علی الصعید الدولی، حقیقة واقعة.
This study aims to ask a question about the mechanisms by which the national criminal law can be an
effective instrument to enforce the provisions of international humanitarian law. Ask this question has become a
necessity for us Arabs, especially the criminal prosecution of perpetrators of violations of international humanitarian
law before the International Criminal Court in The Hague is often faced with obstacles placed by some countries,
seeking to evade its international obligations. They always reject the ratification of the Statute of the Court, and
sometimes hinder the activity of this Court by bilateral agreements to avoid criminal prosecution against its citizens
before it, and other times they press on Security Council to ignore the violations of international humanitarian
law and not use his authority for referral to the ICC Prosecutor under the Statute. The recent war launched by
the Israeli occupying forces in the Gaza Strip is a perfect example of that. Therefore, we must strengthen the role
of national criminal law through a statutory process of integration of international crimes, including violations
relating to international humanitarian law into national legislations. Through investment in the national criminal
law, effective prosecution of perpetrators of international humanitarian law, committed in regional or international
level, can become a reality.
