قانون اساسی،ام القوانین هر کشور و به تعبیری آیینه ی تمام نمای نظام سیاسی و حکومتی آن می باشد. در جمهوری اسلامی ایران نیز به دنبال وقوع انقلاب اسلامی،اولین قانون اساسی در 1358با همه پرسی عمومی به تصویب رسید.شتابزدگی انقلابیگری بزودی خودرا در آن قانون نشان داد. حوادث جنگ تحمیلی و بازسازی کشور و لزوم بازنگری در این قانون با توجه به تاکید امام خمینی (ره) مبنی بر حذف مرجعیت در شرایط رهبری و تعیین رهبر به جای ایشان و تاسیس مجمع تشخیص مصلحت نظام از خاستگاه های اصلی این تغییر بود. اما نگرش عمیق نشان می دهد که تعارضات و تزاحمات در اصول قانون اساسی حاضر از اموراتی هستند که ورطه تصمیم گیری به ویژه در حوزه های حقوقی ، اجتماعی و اقتصادی و حتی سیاسی را به چالش کشیده و در مواردی حتی به قفل شدن بیش از پیش امور انجامیده است.
