در احکام فقهی دین مبین اسلام» جواز ازدواج دختران از بدو تولّد به چشم میخورد که تقریبا مورد اتفاق علمای متقدّم قرار گرفته است. علاوه بر این» به زوج حق هرگونه استمتاع، به جز رابطة زناشویی قبل بلوغ سنی، داده شده است. هدف این مقاله نشان دادن پیامدها و آثار سوء مترنّب بر این حکم فقهی بود که به موجب این پیامدهای منفی، تعارضاتی با اصل عدالت نمایان شد. در این مقاله» با روش توصیفی-تحلیلی» ابتدا قاعدة عدالت و چگونگی کاربرد آن در احکام فقهی و مواردی را که این قاعده داخل میشود، تبیین شد و سپس پیامدهای منفی فردی» خانوادگی و اجتماعی این حکم فقهی و پیامدهایی که در نکاح صغیره» مصداق ظلم تلقّی میشود و مفاسد مترتب بر آن تبیین شد. بر اساس یافتههاء از جمله پیامدهای منفی روحی و روانی میتوان به مواردی چون: افسردگی و اضطراب، سلب عشق و محبّت بر اثر تحمیل مسئولیّت خارج از حد توان و پیامدهای دوری از دوران شیرین کودکی اشاره کرد. همچنین» پیامدهای جسمی و جنسی مانند: آسیب به اندام تناسلی و مرگ و میرء پیامدهای اجتماعی و خانوادگی مانند: طلاق عاطفی و عدم توانایی در تربیت فرزندان» نیز از مصادیق بیعدالتی در این حکم هستند که با قاعدة عدالت که اصلی عقلائی و منطبق بر مذاق شارع مقدّس است» در تعارضاند. بنابراین، با عنایت به اینکه اصل نکاح از امور عقلائی است و تحقق آن منوط به احراز اصول عقلانی است، هرجا با اصل عقلائی در تعارض باشدء مرجوح میگردد. بر اساس نتایج این تحقیق، اصل جواز نکاح صغیره جز در مواردی است که میتواند توسط فقیه و مجتهد مورد بازنگری قرار گیرد و شرایط زمانی» مکانی و خاص اجتماعی امروز در آن لحاظ شود.
In the jurisprudential rulings of the religion of Islam, the permission to marry girls can be seen from
birth, which has almost been agreed upon by the earlier scholars. In addition, the couple is given the
right to enjoy everything except the marital relationship before puberty. Accordingly, the purpose of
this article is to show the consequences and adverse effects of this jurisprudential ruling, according to
which, conflicts with the principle of justice have emerged. In this article, the author, using a
descriptive-analytical method, states two main topics. One is the rule of justice and how it is used in
jurisprudential rulings and the cases in which this rule is included, and the other is the cases in which
minor marriage is considered as an example of oppression. In fact, he stated the corruptions that are
arranged for the permission of this ruling. In the end, with these two bases, he came to the conclusion
that minor marriage, because it has corruption and harms, including negative psychological, physical,
sexual, social and family consequences, is an example of injustice, and is in conflict with the rule of
justice, which is also a rational principle and in line with the taste of the Holy Shari'a. Therefore,
considering that the principle of marriage is a rational matter and its realization is subject to the
realization of rational principles, it is preferred wherever it is in conflict with the rational principle.
Therefore, the author concluded in this article that the principle of permitting a minor marriage needs
to be reviewed by the jurist and mujtahid in order to take into account the temporal, spatial, and social
conditions in that ruling.
