نگارش، در اواخر هزاره چهارم در جنوب بین النهرین ابداع شد و به انسان این امکان را داد که اسناد مکتوب تولید کند. یکی از مهمترین این اسناد، اسناد حقوقی هستند. جامعه سومری، قدیمی ترین اسناد حقوقی را برای ما به جای گذاشته است که با مطالعه آنها می توان چگونگی شکلگیری حقوق در نخستین جوامع شهری را بررسی کرد. در این مقاله، فرمان اوروکاگینا، شاه لگش و تفسیر سنتی این متن، به طور انتقادی مطالعه میشود. یکی از نتایج بررسی قانونگذاری اوروکاگینا، پیدا شدن دیدگاهی تازه درباره خاستگاه اندیشه اتحاد دین و دولت است.
Writing was invented in late 4th millennium BC in southern Mesopotamia and consequently written documents were produced. Legal documents are among the most important documents left to us from ancient Mesopotamia. Sumerian legal documents allow us to study the formation of law in the earliest urban societies. In this paper we study the edicts of Uru-Ka-gina (also read Iri-Ka-gina). Old and new interpretations of this magnificent text are examined. This essay proposes a new perspective about the origin of the idea of divine rule.
