Abstract:
وقتی شخصی جرمی مرتکب می شود قواعد مورد احترام جامعه را نقض کرده و باعث ایجاد ضررهای جانی و خسارات مالی می گردد.عدالت کیفری موجود در جوامع امروزی حکم می کند که مرتکب در دادگاهی صالح محاکمه شده و به مجازاتی متناسب با عمل ارتکابی خویش محکوم و خسارت زیان دیده جبران گردد.حال اگر مجازات صادره در حق مجرم متناسب با جرم او نباشد و یا اصلا مرتکب به سزای عملش نرسد و خسارت زیان دیده جبران نگردد عدالت کیفری محقق نخواهد شد.یکی از موانع اجرای عدالت کیفری بروز اشتباهات قضایی در دستگاه دادگستری است که علل مختلفی را می توان برای آن برشمرد. شاید یکی از مهمترین این دلایل استفاده از ابزارهای ناکارآمد برای اثبات جرم در دادگاه ها باشد.اتکای صرف به دلایل سنتی مانند شهادت و اقرار و غافل ماندن از علوم و فناوری های جدید کشف جرائم که امروزه در بسیاری از کشورهای پیشرفته دنیا برای حل پیچیده ترین پرونده های جنایی از آن استفاده می شود ممکن است باعث گسترش خطر بروز اشتباهات قضایی گردد.بررسی های انجام شده برروی اقرار و شهادت نشان دهنده آن است که این دلایل به شدت آسیب پذیر بوده و می تواند به راحتی دستخوش حالات روانی و حتی نیازهای جسمانی فرد گردد.ذهن انسان می تواند در مواقع هیجان به راحتی حادثه ای را محو سازد و یا طور دیگری در پیش خود مجسم کند. به عبارت دیگر نتایج بررسی روان شناسانه بر روی دلایلی مانند اقرار و شهادت حاکی از آن است که این دلایل در بسیاری از موارد غیر قابل اعتماد و فاقد ارزش قضایی هستند و با استناد صرف به آنها نمی توان به عدالت کیفری در کشور دست یافت. پس باید این خلاء را به گونه ای جبران کرد و آن نیز استفاده از علوم ودانش جدید جرم یابی است.فناوریی که نه نتها منجر به کاهش اشتباه در شناسایی هویت مرتکب جرم می شود،بلکه باعث سرعت بخشیدن به روند دادرسی و به تبع آن مجازات مرتکب و جبران خسارت مجنی علیه و خانواده او نیز می گردد.
