Abstract:
اگرچه آزادی ارائه دلیل از سوی مدعی در زمان و مراحل مختلف دادرسی مطابق با هدف اصلی قانونگذار از وضع ماده 199 یعنی کشف حقیقت است، ولی اگر قانونگذار در پذیرش دلیل از مدعی گشاده رویی از خود نشان دهد و اجازه دهد، هر لحظه مدعی اراده کند تا دلیل خود را ارائه دهد و در نتیجه مورد پذیرش دادگاه قرار گیرد؛ اطاله دادرسی را فرا می‌گیرد و نوعی بی‌نظمی در سیستم قضایی در پذیرش دلیل محسوب است. در تقابل اجرای عدالت با نظم در دادرسی؛ طرفداری محض از یکی به زیان دیگری می انجامد؛ برای همین با استقرا در قانون آ.د.م در پذیرش دلیل از سوی مدعی باید قائل به نوعی تمرکز در زمان ارئه ادله و ارائه کلی و یکجا بود تا با اجرای قاعده «الجمع مهما امکن اولی من الطرح» هر دو هدف قانونگذار حاصل شود.
