Abstract:
زمینه و هدف: دغدغه جرمشناسان و سایر پژوهشگران علوم اجتماعی برای کاهش جرائم موجب شده است تا آنان پژوهشهای تجربی متعددی برای شناسایی مشکلات و موانع اثربخشی ناکافی برنامههای پیشگیرانه یا اثربخشی پایین آنها انجام دهند. با توجه به ضرورت بکارگیری چنین رویکردی برای شناسایی و حل مشکلات موجود در این زمینه در نظام عدالت کیفری ایران، مسئله اصلی پژوهش حاضر، بررسی موانع اثربخشی راهبردهای پیشگیری از جرائم علیه امنیت اخلاقی در فضای مجازی و ارائه راهکارهایی برای رفع آنها است. روش: برای پاسخگویی به پرسش پژوهش، ضمن بررسی اسناد و قوانین موجود در این زمینه، از روش مصاحبه عمیق با ۲۰ نفر از کارشناسان و مجریان برنامههای پیشگیری از جرائم علیه امنیت اخلاقی در فضای مجازی استفاده شد. یافتهها و نتایج: یافتههای پژوهش بیانگر چندنکته اساسی است:نخست آنکه همکاری ضعیف،انجام وظایف مشابه ومناسبات قدرت میان نهادهاموجب شده است تا پیشگیری چندنهادی از جرائم علیه امنیت اخلاقی در فضای سایبر براساس اهداف مورد نظر عینیت نیابد. در این میان، مشارکت ضعیف میان بخش خصوصی و دولتی به همراه سهم ناچیز مردم و انجمنهای مردمنهاد، از دیگر موانع اثربخشی مداخلههای پیشگیرانه دراین حوزه به شمار میروند. افزون بر این، بسیاری از طرحها و برنامههای پیشگیری بدون ارزیابی اجرا میشوند و پس از اجرا نیز میزان اثربخشی آنها سنجیده نمیشود. همچنین استفاده بیش از اندازه از فیلترینگ و معرفی آن به عنوان یکی از راهکارهای درست برای پیشگیری از جرائم سایبری، نه تنها ممکن است موفقیتآمیز نباشد، بلکه پیامدهای ناخواستهای نیز به بارخواهد آورد که اثربخشی این اقدامات را دچار تردید میکند.
Background and Aim: Criminologists and other social science researchers' concerns about crime reduction have led them to conduct numerous empirical studies to identify problems and barriers to inadequate or ineffective prevention programs. Given the necessity of applying such an approach to identifying and resolving problems in the field of criminal justice in Iran, the main issue of the present study is to investigate the barriers to the effectiveness of cyber-crime prevention strategies and provide solutions to them. Method: In order to answer the research question, in addition to reviewing the existing documents and rules, in-depth interviews were conducted with 4 experts and executives of ethical crime prevention programs in cyberspace. Findings and Results: The findings of the study suggest several key points: First, poor co-operation, similar tasks, and power relations between institutions are needed to prevent multi-institutional prevention of crimes against ethical security in cyberspace based on the intended objectives. In the meantime, weak partnerships between the public and private sectors, along with a modest share of people and public associations, are other barriers to the effectiveness of preventive interventions in this area. In addition, many prevention plans and programs are implemented without evaluation and their effectiveness is not measured after implementation. Overuse of filtering and its introduction as one of the right strategies to prevent cybercrime may not only be unsuccessful but it will also have unintended consequences that will undermine the effectiveness of these measures.
