Abstract:
افزایش هزینه‌های دادخواهی (هزینه‌ی دادرسی، حق الوکاله و غیره)، دسترسی به دادگاه را برای شماری از افراد با چالش جدی روبرو ساخته است. در راستای حل این مشکل و هموار ساختن دسترسی ایشان به دادگستری، راهکارهای گوناگونی چون حق‌الوکاله اتفاقی، بیمه هزینه‌های دادخواهی و قرارداد تأمین هزینه‌ها بوسیله ثالث در نظامهای حقوقی اندیشیده شده است. نهاد اخیر قراردادی احتمالی است که اولین بار در دهه نود قرن بیست در استرالیا پی‌ریزی و سپس در کشورهای دیگر پذیرفته شد. قرارداد میان یک سرمایه‌گذار و خواهان منعقد و برابر آن، سرمایه‌گذار در ازای دریافت درصدی از محکوم‌به احتمالی، هزینه‌های دادخواهی را می‌پردازد. استدلال‌هایی له و علیه این شیوه به عمل آمده است؛ در حقوق امریکا مخالفین آنرا به دلیل نقض قاعده‌ی ممنوعیت مداخله ثالث در دادرسی، مخالفت با نظم عمومی، افزایش شمار دعاوی، ترغیب دعاوی واهی و کاهش انگیزه سازش باطل دانسته‌اند. در برابر، برای اعتبار آن به نیاز جامعه، مصالح اقتصادی و اجتماعی، تسهیل دسترسی افراد به دادگستری، پیشگیری از دادستانی فردی، افزایش انگیزه سازش و پیشگیری از طرح دعاوی واهی، استدلال شده است. در حقوق ایران علاوه بر برخی دلایل فوق، ممکن است بر پایه غرری بودن قرارداد، اعتبار آن با چالش روبرو شود.
Commercialization of justice and increasing in litigation costs (court costs, fees etc.) has challenged access to court for some individuals. In order to remove this problem and facilitate their access to court, various mechanisms such as contingency fees, legal expenses insurance and funding litigation costs by third parties have been devised. The latter institution is an aleatory contract that for first time established during 1990S in Australia and then was accepted in other countries. The contract is concluded between a funder and a plaintiff, by which the former pays plaintiff’s litigation costs in exchange for share of recovery. There are arguments for and against it. The critics consider the contract void due to being Qarar, ignoring the prohibition of maintenance and champerty rules, contrast with public policy, increasing the actions, encouraging unmeritorious claims and reducing the settlement’s incentive. Conversely, it could be considered valid based on the society’s need and social and economic interests, facilitating individual’s access to court, preventing from private justice, increasing incentive to settle and preventing to file baseless suit
