Abstract:
در ایران ممنوع بودن مداخله خارجی‌ها در انتخابات اگرچه از منظر اصل عدم مداخله در امور داخلی کشورها همواره مورد تأکید بوده است، نبود مقرراتی جامع در این خصوص که تمامی ابعاد مداخله انتخاباتی را در برگیرد، واقعیتی انکارناپذیر است. پژوهش حاضر کوشیده است تا با روشی توصیفی-تحلیلی، ضمن بررسی چارچوب‌های قانونی ناظر بر ممنوعیت مداخله در انتخابات در سایر کشورها، نظام حقوقی ایران را در این عرصه بررسی کند، سپس با مقایسه نظام حقوقی ایران با این کشورها و با توجه به نقاط ضعف و قوت ایشان، به ارائه الگویی جامع در ممنوعیت مداخله بیگانگان در انتخابات ایران دست یابد. نتایج این بررسی نشان داد در قوانین عادی ایران در مقایسه با دیگر کشورها آنچه بیش از همه مورد تأکید است، ممنوعیت مداخلات و حمایت‌های مالی است و به مداخلات غیرمالی چندان توجهی نشده است. سیاست‌های کلی نظام در انتخابات هم به ممنوعیت استفاده از حمایت و امکانات بیگانگان اعم از مالی و تبلیغاتی اشاره کرده است، لیکن نبود سازوکار منطقی و معقول اجرای این سیاست‌ها مانع مهمی در اجرایی کردن آن‌هاست. ابتکارات تقنینی ناظر بر انتخابات در کشور ما نیز در این مسئله از جامعیت کافی برخوردار نیستند و معمولاً تنها ممنوعیت کمک‌ها و منابع نقدی و غیرنقدی را در برمی‌گیرد ، ازاین‌رو پیشنهاد می‌شود در قانون جامع انتخابات به حوزه مداخله انتخاباتی اعم از مالی و غیرمالی، چنانکه روش‌های نوین مداخله را در برگیرد، توجه ویژه و شایسته‌ای شود.
Foreign interference in elections as a means of political influence in other countries. Some countries have laws that explicitly prohibit foreign interference in their elections. The ban covers financial and non-financial interference. In some countries, a general ban on political interference has been emphasized by lawmakers. In the Iranian legal system, the prohibition of foreign interference in elections is not explicitly enshrined in any of the principles of the constitution. Only “the Law on Transparency and Supervision of the Financing of Electoral Activities in the Elections of the Islamic Consultative Assembly”, explicitly prohibits the financial interference of foreigners in the parliamentary elections and does not pay attention to non-financial interference. However, in the sixth paragraph of “the General Policies of the System in the Elections”, the prohibition of the use of the support and facilities of foreigners, including financial and propaganda, by the candidates and parties is mentioned. Although the scope of these prohibitions in those policies, including financial and propaganda, the lack of instructions and regulations for carrying out these policies, remains an important obstacle in front of their implementation. The comprehensive election bill, which has not yet been approved, lacks the necessary comprehensiveness and only includes the ban on cash and non-cash resources aids. Therefore, it is suggested that in the Comprehensive Electoral Law, special attention be paid to the field of electoral intervention, both financial and non-financial, as it includes new methods of intervention.

عده اي ديگر از چنين تقسيم بندي با عنوان مداخله جانبدارانه و مداخله فرايندي نام برده اند که در اولي قدرت خارجي موضع حمايت از يک طرف (کانديدا يا حزب معين شرکت کننده در انتخابات ) اتخاذ ميکند و در دومي قدرت خارجي به دنبال آن است از قواعد رقابت هاي دموکراتيک صرف نظر از اينکه چه کسي برنده شود، حمايت کند ( Corstange ٦٦٠ :٢٠١٢ ,Marinov &) و بدين منظور از روش هايي چون ارائه مشاوره حقوقي و نظارت بر انتخابات استفاده ميکند (٢١٥ :٢٠١٢ ,Kelley).
