Abstract:
يعتبر الالتزام بإنقاذ الأشخاص المكروبين في البحر بغض النظر عن جنسيتهم أو مركزهم أو الظروف التي وجدوا فيها، من
أقدم القواعد العرفية في قانون البحار، ويتفرع إلى التزامين متكاملين هما التزام بتقديم المساعدة، ويقع على ربابنة السفن؛
والتزام بالتنسيق والتعاون بغرض إنزال الأشخاص الذين يتم إنقاذهم في البحر في مكان آمن؛ ويقع على عاتق الدول،غير أنه بعد
إنجاز عملية الإنقاذ، يمكن أن تستجد مشاكل تتمثل في الحصول على موافقة الدول على إنزال الأشخاص المنقذين في إقليمها،
حيث أن رفض الدول السماح للسفن بالرسو على موانئها وإنزال الركاب فيها، إضافة الى ملاحقة ربابنة السفن بتهمة تهريب
المهاجرين، يدفعهم إلى التخلف عن الوفاء بالتزامهم بالإنقاذ.
The obligation to rescue persons in distress at sea, without regard to their nationality, status, or the circumstances
in which they found, is a long standing maritime tradition, this obligation rests with shipmasters, it is complemented by
an obligation of states, to cooperate, so that persons, are disembarked in a place of safety Even when the rescue has been
accomplished, problems can arise in securing the agreement of states to the disembarkation of rescued persons. Therefore
countries' refusals to allow ships to disembark passengers in their ports , as well as to prosecute shipmasters for the crime
of migrant smuggling, may deter them from fulfilling their obligation of rescue.
