Abstract:
بر اساس نظام حقوقی در جمهوری اسلامی ایران، از سازمان صداوسیما به‌‌عنوان رسانه ملی یاد می‌شود و از این حیث، صداوسیما از جایگاه ویژه‌ای برخوردار است و سازوکارهایی برای نظارت بر فعالیت‌های آن پیش‌بینی شده است. در پژوهش حاضر سعی شده است با استفاده از منابع کتابخانه‌ای و در پرتوی نگرشی به رویه عملی مجلس شورای اسلامی، به تشریح ابعاد ابزارهای نظارتی مجلس بر صداوسیما پرداخته شود. باوجود ابزارهای متعدد نظارت مجلس از‌جمله کمیسیون اصل نود قانون اساسی، تحقیق و تفحص، نظارت حقوقی از طریق قانونگذاری، نظارت مالی دیوان محاسبات، نطق و … به نظر می‌رسد که با‌توجه‌به ماهیت سازوکارهای یاد شده و نیز جایگاه ویژه رسانه ملی مطابق نظریه تفسیری اصل یکصد‌و‌هفتاد‌و‌پنجم قانون اساسی، موثرترین سازوکار نظارتی مجلس شورای اسلامی بر رسانه ملی، حضور دو تن از نمایندگان در شورای نظارت بر سازمان صداوسیمای جمهوری اسلامی ایران است که در این خصوص نیز نتیجه نظارت این شورا بر صداوسیما، چیزی جز اعلام موارد کشف شده به مقام معظم رهبری نخواهد بود. از‌این‌رو، پیشنهادهایی مبنی بر اصلاح ترکیب شورای نظارت، بهبود تارنمای شورای نظارت با هدف پیش‌بینی امکان طرح شکایت در آن، تقویت شورای نظارت از طریق اصلاح قانون اساسنامه سازمان صداوسیما و ایجاد سازوکار ارجاع تخلفات به قوه‌قضائیه به همراه تشدید مجازات‌های مربوط به بی‌انضباطی مالی ارائه شده است.
According to the legal order in the Islamic Republic of Iran, the Broadcasting Organization is referred to as the national media, and in this respect, the IRIB has a special position and mechanisms are foreseen to monitor its activities. In this research, an attempt has been made to describe the dimensions of the parliament's monitoring tools on IRIB by using library resources and in the light of the practical procedure of the Islamic Parliament. In spite of the many supervisory tools of the parliament, including the commission of Article 90 of the Constitution, research and investigation, legal supervision through legislation, financial supervision of the Court of Accounts, speeches, etc., it seems that according to the nature of the aforementioned mechanisms and the special position of the national media, according to the interpretation theory Article 175 of the Constitution, the most effective supervisory mechanism of the Islamic Parliament on the national media is the presence of two representatives in the Supervisory Council of the Islamic Republic of Iran Broadcasting Organization. In this regard, the result of this council's monitoring of IRIB will be nothing but announcing the discovered cases to the Supreme Leader. And hence the proposals to amend the composition of the Supervisory Council, improve the website of the Supervisory Council with the aim of predicting the possibility of filing a complaint, strengthening the supervisory council by amending the statute of the IRIB organization and creating a mechanism to refer violations to the judiciary, as well as intensifying the punishments related to non-compliance with financial discipline, have been presented.
