Abstract:
در «حقوق هنر»، صاحبان «رفتارهای نمایشی» در جلوههای عمومی مانند تئاترها، بهعنوان موضوع حقوق و تکالیف مطرح هستند. حق شهرت سینماگران و ماهیت آن در «حکومت دینی» از منظر فقهی-حقوقی و همسو با کارویژههای حکومت دینی، محور اصلی نوشته حاضر است. سؤال اساسی دربارۀ ماهیت حقوقی و فقهی حق بر شهرت سینماگران در حکومت دینی؛ اعم از آنکه شهرت ناشی از فعالیت در رسانه دولتی باشد یا در سایر رسانهها است و اینکه مبتنی بر این ماهیت، سهم حکومت دینی در این حق بر شهرت چیست و چنانچه بتوان سهمی برای حکومت دینی درنظر گرفت، بر چه اساس و با چه ملاحظاتی خواهد بود. اساساً حق حکومت دینی بر سینماگران، محدود به این قبیل هنجارها نیست و «ماهیت حقوق خصوصی-عمومیِ» حقوق هنر و رسانه، ایجاب میکند، تأثیر حکومت دینی بر سعه و ضیقِ حقوق این رسته از هنرمندان بر اثر نمایشی خود (ازجمله در قالب ممنوعیت تصویری سینماگران و یا حمایت مالی و معنوی از سینماگران) نیز در مرحلۀ بعد بررسی شود. همچنین این نوشتار در «الزامات حکومتی»، با عنایت به «حقوق سینماگر»، گستره و ماهیت این حق را نیز درنظر خواهد داشت. این الگو با ویژگیهایی که شرح داده شد، با روش توصیفی-تحلیلی و مبتنی بر تفهم اجتهادی از منابع فقهی و «مطالعات کتابخانهای» انجام شده است. اینگونه بررسی، میتواند هدف «حمایت» از حق شهرت سینماگران را در ضمن حمایت از شهرت آثار سینمایی و صیانت از حقوق جامعهبستر و نیز حکومت را محقق کند. بر این اساس مالیت و مالکیت حق بر شهرت فهم میشود و براساس آن، امکان نظارت بر آثار سینمایی و نیز درج برخی شروط محدودیت فعالیت در قراردادهای سینمایی قابل توجیه است.
The “law of art” is the right to discipline and regulate the work of professional performers in conventional art forms such as theater. In this paper, I aim to explore the right of fame for filmmakers and actors in terms of the principles of a religious government and from the perspective of Islamic juridical-legal views. Focusing on the juridical-legal aspects of the fame of actors and actresses in a religious government, Regardless of the fame earned from public or private media, the questions raised what is the role of religious government in the “law of art”? And if the role is conceived, on what legal basis this role is defined? Basically, the relationship between the government and filmmakers is not limited to the right to fame. Reviewing the public-private rights in the law of art and media leads to investigating issues such as the legal ban of the filmmakers and actors or their spiritual and financial support. Taking into consideration the legal rules, liability, and the law of the artist, the present inquiry aims to discuss the basis and development of the law. In this regard, I presented a model based on a descriptive-analytical method of studying juridical literature. Studying the issue can pave the way to clarify the purpose of supporting the rights of filmmakers and actors, as well as the fame of the movies, society, and the government. Moreover, this study shows the legal aspects of the government's observation and legal conditions for the limitation of the filmmakers and actors in their movie contracts.
