Abstract:
سلامت و مصونیت از هر عاملی که به نحوی سلامت مستمر جسمانی، روانی و شخصیتی فرد را به خطر می اندازد، یکی از حق های مسلم بشری است. متناظر با این مولفه مهم و مبنایی زیست سالم، حق بر سلامت، امروزه یکی از اصلی ترین و بنیادی ترین حقوق انسان هاست که در اسناد بین المللی مختلف نیز به وضوح به این امر اشاره شده است. دولت های عضو یا ملحق به این اسناد نیز تعهد بر تأمین و تضمین این حق دارند و بدین ترتیب، قصور یا تقصیر آن ها در تأمین یا تضمین حق پیش گفته، موجبات مسئولیت آن ها در برابر شهروندانشان را فراهم می آورد و چه بسا سبب تحقق مسئولیت بین المللی آن ها در برابر دیگر دولت ها و شهروندان نیز بشود. جلوه بارز تأمین و تضمین حق بر سلامت، در مورد مصرف کنندگان، مطرح است. بدین سان، تأمین و تضمین حق بر سلامت مصرف کنندگان، به مثابه یک تکلیف و تعهد عمده و اصلی، امروزه بر عهده دولت ها قرار گرفته است. با وجود این، نحوه تأمین و تضمین این حق در عمل نیز از اهمیت خاصی برخوردار است. در این میان، حمایت کیفری از حق بر سلامت، مهم ترین و موثرترین نوع حمایت حقوقی از این حق به شمار می رود. این حمایت، از رهگذر جرم انگاری هر رفتاری که به نحوی، این حق را نقض کرده و یا در معرض نقض قرار می دهد، جلوه گر می شود. از سوی دیگر، آنچه می تواند تضمینی مناسب برای تحقق عملی حمایت کیفری از حق بر سلامت باشد، دادخواهی پذیری آن است.
Health and immunity from any factor that somehow endangers the continuous physical, mental and personal health of a person is one of the indisputable human rights. Corresponding to this important component and the basis of a healthy life, the right to health is one of the most basic and fundamental human rights today, which is clearly mentioned in various international documents. The states that are members or acceded to these documents also have an obligation to provide and guarantee this right, and thus, their failure or fault in providing or guaranteeing the above-mentioned right, causes their responsibility towards their citizens and may be the reason for its realization. their international responsibility towards other governments and citizens. The obvious effect of providing and guaranteeing the right to health is relevant for consumers. Thus, providing and guaranteeing the right to the health of consumers, as a major and main duty and obligation, has been entrusted to the governments today. Despite this, the way to secure and guarantee this right in practice is also of particular importance. Meanwhile, criminal protection of the right to health is considered the most important and effective type of legal protection of this right. This protection is manifested through the criminalization of any behavior that somehow violates or exposes this right to violation. On the other hand, what can be a suitable guarantee for the practical realization of the criminal protection of the right to health is its appealability. Susceptibility, in a simple sense, means that any citizen who sees his right to health violated or violated by the government or natural persons, can seek judicial guarantee by filing a lawsuit or complaint.
