Abstract:

رفتارهای مجرمانه ی خشونت آمیز آسیب‌های فراوانی را به جامعه و شهروندان تحمیل مینماید. مطالعه و شناخت علل و عوامل این پدیده شناسایی گونه‌های متعدد آن، هم چنین واکاوی رابطه ی خشونت و جرم و در نهایت بررسی راه کارهای پیش‌گیری امری ضروری است. در پژوهش حاضر، در بررسی تحلیلی - توصیفی این پدیده، بروز تحلیل قانون کاهش مجازات تعزیری بر حرائم خشئت بار پداخته شده است. نقش موثری در پیدایش انواع خشونت ایفا میکنند. قانونگذار بدون منطق یکسان و به طور بی‌ضابطه اقدام به کاهش حبس تعزیری در ابعاد مختلف نموده است و اینکه جرایم علیه امنیت از قبیل سرقت و یا جرایم خشونت آمـیز از قـبیل آدم ربایی موضوع ارفاق قانونگذار قرار گیرند خود نوعی از بین رفتن قدرت و قاطعیت و بازدارندگی قانون در جامعه است و لطمات جبران ناپذیری را به جامعه وارد خواهد ساخت و مضافا اینکه رویه قضایی و احکام دادگاهها نشانگر آن است که به عنوان مثال جرایم مهمی از جمله سرقت با گذشت شاکی به راحـتی مـختومه مـی شوند و این امر باعث خواهد شد که احکام دادگاه‌ها و دادسـراهای جـنایی نیز در مبارزه با جرایم از بازدارندگی اندکی برخوردار باشند.
