و لا حاجة الی اعلان جدید للسیر فیما سکت وکیل المدعیة عن طلبه و قد عاد الیه فی‌ نفس المجلس اکتفاء بالاعلان السابق لان هذا لیس بدعوی جدیدة و انما هو استمرار فی‌ نفس الدعوی بالمسکوت عن طلبه منها و لم‌ یتغیر المجلس اذ لیس ذلک بشی‌ء جدید خارج‌ عن الموضوع المنظور السابق الاعلان به‌ خصوصا أن المحکمة لم تقرر شیئا فیما سکت‌ وکیل المدعیة عن طلبه و لم یفصل فی الدعوی‌ و لا زالت قائمة و خصوصا أن النص الفقهی‌ أیضا یوجب علی القاضی السیر فی الدعوی‌ مادام الخصم حاضرا و یرید المدعی الادعاء علیه و القانون لا ینافی ذلک و قد قدم وکیل‌ المدعیة اثباتا علی الدعوی بعد الاثبات‌ المذکور فیتعین حینئذ رفض هذا الدفع و من حیث ان الدعوی ثبتت بما ذکر و قد ثبت من المرافعة ان طاعة المدعیة غیر واجبة علیها للمدعی علیه لنبوت بقاء بعض‌ عاجل الصداق و قد تبین من الشهادة مناسبة الآتی لهذا فرضنا للمدعیة سیدة بنت موسی بن خلیفه‌ علی المدعی علیه حسن بن عویس بن صلاح‌ فی کل شهر من تاریخه خمسة و سبعین قرشا صاغا لطعامها و ادامها من ذلک ستون و مثلها لبدل کسوتها فی کل ستة أشهر و الخمسة عشر الباقیة لا صلاح شأن البنت المذکورة و مثلها لبدل کسوتها کل أربعة أشهر و أمرناه بأداء ذلک الیها و بتهیئة مسکن شرعی و رفضنا الدفع المذکور حضوریا تعلیق مضی میعاد الاستئناف و لم یستأنف‌ 191 محکمة الازبکیة الشرعیة حکم 62 یونیه سنة 9291 موضوعه:قضاء المجلس الملی بین الزوجین‌ بعد اسلام الزوج-زواج الزوجة بغیر زوجها المحکوم من المجلس الملی بالتفریق بینها و بینه- طریق الخصومة فی أمر طارئ بعد الحکم الغیابی‌ القاعدة اذا أسلم الزوج المسیحی فقاضته زوجته‌ بعد اسلامه الی المجلس الملی فقضی هذا المجلس‌ بالتفریق بینها و بینه فتزوجت بغیره فالقضاء والزواج باطلان و دعوی ارتداد الزوج عن‌ الاسلام بعد الحکم الغیابی علی زوجته بالطاعة لا تقبل دفعا لذلک الحکم من طریق المعارضة و انما طریق المخاصمة فیه تکون ابتداء بالجلسة الجزئیة المنعقدة علنا بمحکمة الازبکیة الشرعیة فی یوم الأربعاء 91 المحرم‌ سنة 8431(62 یونیه سنة 9291)لدی أنا محمد احمد فرج القاضی بها و بحضور احمد عبد الفتاح افندی کاتب الجلسة صدر الحکم‌ الآتی فی القضیة الجزئیة نمرة 5501 سنة 82- 9291 المرفوعة من فتنة کامل الشهیرة بتونیه‌ ضد رشدی حبیب محروس الشهیر بعبد الله‌ رشدی بشأن معارضة الوقائع طلب وکیل المعارضة قبول المعارضة شکلا لتقدیمها فی المیعاد القانونی و موضوعا بالغاء الحکم المعارض فیه لاسباب هی(أولا) أنه تمسک بما دفع به فی القضیة المعارض فیها و ضم للموضوع و لم تفصل فیه المحکمة و بطلب‌ رفض الدعوی.
