چکیده:
مصرف کننده به علت قدرت اقتصادی و چانه زنی کمتر نیازمند حمایت ویژهای در برابر قدرتمندان میباشد و صرف توجه به اصل آزادی قراردادی، حقوق او را تضمین نمیکند. مصرف کنندگان بورس اوراق بهادار هم که بخشی از بازار مالی در برابر بازار واقعی هستند، مستثنی از این امر نبوده و حتی به علت تخصصی تر بودن بازارهای مالی، توجه به قشر ضعیف از فعالان این بازار اهمیت بیشتری دارد. لذا باید مصرف کنندگان موردنظر شناسایی و مشمول حمایتهای خاص قرار گیرند. اشخاصی که در بورس سرمایه گذاری میکنند، دو دستهاند که برخی از آنها مبتدی و غیرحرفهای و بعضی دیگر متخصص میباشند و بدیهی است که دسته اول نیازمند حمایت ویژه میباشند. اگرچه برخی، معتقد به عدم امکان اجرای قواعد حقوق مصرف در بورس اوراق بهادار هستند، اما بنظر میرسد علیرغم سکوت قانونگذار، باید سرمایه گذاران خرد این بازار که شغل اصلی آنها معامله اوراق بهادار نبوده بلکه حرفه فرعی و مکمل محسوب شده و دارای ضعف اطلاعاتی میباشند، را مصرف کننده نامیده و محق استفاده از مزایای خاص قانون حمایت از حقوق مصرف کنندگان مصوب 1388 کشورمان و سایر مقررات مرتبط دانست. در مقابل؛ سرمایه گذاران نهادی، که اشخاصی هستند متخصص و معامله اوراق بهادار در بورس حرفه اصلی آنها بوده و به علت قدرت اقتصادی و اطلاعاتی نیازمند حمایت ویژه قانونی نمیباشند. همانطور که ملاحظه میگردد، مفهوم مصرف کننده در بورس تا حدودی با تعریف مرسوم آن در قوانین مربوطه متفاوت میباشد.

In contrast, institutional investors, who are specialist people and securities trading in their main job and due to economic and information power, they do not require special legal protection. As you can see, The concept of consumer in the exchange is somewhat different from the traditional definition in the relevant laws.
