چکیده:
فرزندخواندگی نهادی ضروری در جوامع کنونی به حساب می آید که علاوه بر تأمین منافع کودکان بی سرپرست و زوجین بدون فرزند، تأثیرات اجتماعی مثبتی به دنبال خواهد داشت و نیاز است که قواعد آن با مقتضیات اجتماعی انطباق یابد. در این مطالعه، ماهیت، شرایط و آثار فرزندخواندگی در حقوق ایران با نگاهی تطبیقی در حقوق اسلام و همچنین حقوق انگلستان، بررسی شد. تحلیل داده ها حاکی از آن است که در حقوق ایران به تبعیت از حقوق اسلام، فرزندخواندگی به شکل ناقص آن وجود دارد و به رغم پیشرفت و توسعه تقنینی اخیر، آثار فرزندخواندگی در قانون به اندازه کافی و موثر پیش بینی نشده است؛ این در حالی است که مبانی و آموزه های اسلامی ظرفیت هایی را جهت تقویت نهاد فرزندخواندگی با ملاحظه شرایط و اقتضائات اجتماعی نشان می دهند. از طرفی، در حقوق انگلیس سیستم فرزندخواندگی کامل اعمال می شود که براساس آن رابطه ناشی از فرزندخواندگی کاملاً منطبق با رابطه قانونی اطفال و والدین زیستی خود می باشد. با وجود این در قوانین اخیر نوعی از فرزندخواندگی ناقص تحت عنوان قیمومت ویژه نیز در حقوق این کشور شناسایی شده است که این سیستم دوگانه زمینه را برای بهره گیری از رویکردهای گوناگون فرزندخواندگی فراهم آورده است.
Adoption is an essential entity in current societies which in addition to providing the benefits for children without a guardian and couples without children, will have positive social implications and so it’s necessary to adapt its rules to social requirements. In this study, the nature, conditions and effects of adoption in Iranian law were reviewed with a comparative looking at Islamic law as well as English law. Data analysis indicates that in Iranian law, following Islamic law, there is incomplete form of adoption and despite recent legislative progress and development, the effects of adoption are not sufficiently and effectively provided in the law, while the principles and Islamic teachings show capacities to strengthen the entity of adoption by considering social conditions and requirements. In English law, on the other hand, a complete adoption system is applied, according to which the relationship resulting from adoption is fully consistent with the legal relationship between the children and their biological parents. However, in recent rules, a kind of incomplete adoption under the name of special guardianship has been identified in the law of this country, which has provided a dual system for taking advantage of different approaches to adoption.
