چکیده:
زمینه و هدف: یکی از مصادیق ضرر که در قابلیت جبران آن اختلاف وجود دارد، «ضرر ناشی از کاهش ارزش پول» است. بدین معنا که در اثر مرور زمان، «ارزش واقعی» پول برخلاف «ارزش اسمی» آن کاهش یافته و قدرت خرید اولیه آن تغییر یابد.
مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات بصورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: در خصوص قابلیت جبران ضرر ناشی از کاهش ارزش پول در اثر مرور زمان، اختلاف نظر وجود دارد، لیکن به نظر میرسد که دلایل موافقین قابلیت جبران، قویتر است. پول جدای از قیمی یا مثلی بودن چیزی جز قدرت خرید و قوه ابراء نیست.
نتیجهگیری: در تادیه دیون موجّل باید معیار بری الذمه شدن مدیون اداء قدرت خرید دریافتی در روز استقراض باشد. درحال حاضر تنها مقررهای که میتوان در خصوص قابلیت جبران ضرر کاهش ارزش پول بدان استناد کرد، ماده 522 قانون آیین دادرسی مدنی است و بنابراین قاعده کلی در این خصوص، وجود ندارد و قابلیت جبران را با مانع گستردهای روبه رو میکند.
Background and Aim: One example of a loss in which there is a difference in the ability to compensate is "loss due to the devaluation of money". This means that over time, the "real value" of money, as opposed to its "nominal value", decreases and its initial purchasing power changes. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: There is disagreement about the ability to compensate for the loss of value of money over time, but it seems that the reasons for the ability to compensate are stronger. Money is nothing but purchasing power and the power of discharge, apart from being a guardian or like. Conclusion: In the payment of debts, the debtor must be the criterion for the debtor to be discharged on the day of borrowing. At present, the only provision that can be relied on for the ability to compensate for a devaluation is Article 522 of the Code of Civil Procedure, and therefore there is no general rule in this regard, and the ability to compensate faces a broad obstacle.
