چکیده:
بخشی از مشکلات خانوادگی، خشونت جنسی است که اکثراً زنان قربانی میشوند. در مقام مقایسه و تطبیق نوع آزار مبتنی بر جنسیت با فقه، بیشتر آنها بر اساس قاعده عام «نفی ایذاء» یا دلیل اختصاصی ممنوع شدهاند؛ ولی همه آنچه امروزه به عنوان «آزار جنسی» شناخته میشود، در منابع فقهی مطرح نشده و برخی از آنها مثل تجاوز زناشویی، ازدواج اجباری و برخی ممنوعیتها برای ازدواج، از طریق قواعد دیگری جایز شده است؛ چه آنکه در زمان صدور منابع دینی و شکلگیری فقه، برخی از این رفتارها «آزار» شمرده نمیشد یا «آزار ممنوع» بهحساب نمیآمد. در ریشهیابی و توجیه نظری این رفتارها به جهانبینی، نگرش به زنان، فرهنگ و اقتصاد مردسالار میرسیم. البته در فقه ظرفیتهایی وجود دارد که با اجتهادی که به سیره عقلا، عرف و قاعده عدالت اعتبار بیشتری بدهد، میتوان تعارض بین برخی احکام فقهی را با دستآوردهای فرهنگ و تمدن بشری، برطرف نمود.
Part of the family problems is sexual violence, which mostly victimizes women. In comparison with forty types of sexual harassment categorized in jurisprudence, most of them are prohibited under the general rule of "denial of persecution" or for a specific reason. But not everything that is known today as "sexual harassment" is discussed in jurisprudential sources. Some of them are allowed by other rules, such as marital rape, forced marriage, and some prohibitions on marriage. At the time of the issuance of religious sources and the formation of jurisprudence, some of these behaviors were not considered "harassment" or "prohibited harassment". In tracing and theoretically justifying these behaviors, we come to a worldview, a kind of attitude towards women, a patriarchal culture and economy. There are capacities in jurisprudence that can resolve the conflict between some jurisprudential rules and the achievements of human culture and civilization.
