چکیده:
سامانههای اطلاعاتی دیجیتالی و نرمافزارها، بدون شک از مهمترین ابزارها و عناصر مؤثر در حیات اجتماعی بشر محسوب میشوند؛ بهگونهایکه نقش عظیمی در ساحات زندگی اجتماعی، اقتصادی، علمی و آموزشی جامعه ایفا میکنند. در این میان، نظام تعلیم و تربیت نیز از وجود این سامانهها بیبهره نیست و امروزه، از مؤلفههای تسریعکننده در امر آموزش و تربیت، بهکارگیری سامانهها و نرمافزارهای اطلاعاتی هستند که بستر لازم برای بسیاری از فعالیتها و اقدامات تربیتی اعم از آموزشی و تربیتی را فراهم میآورند و بهعنوان بازویی توانا، عاملین تربیت را در امر تعلیم و تربیت یاری میرسانند؛ اما سؤالی که تحقیق حاضر به دنبال آن است، اینکه بر ایراد عیب و نقص سامانهها و نرمافزارهای اطلاعاتی به فرایند تربیت یا متربی، چه احکام فقهی و حقوقی مترتب میگردد؟ آیا تولیدکنندگان این نوع از نرمافزارها در صورت عیب و نقص، مسئولیت دارند؟ آیا در شرع نسبت به جبران خسارات ناشی از نقص سامانههای اطلاعاتی، ادلهای وجود دارد؟ به نظر میرسد بر اساس قواعد فقهی مانند قاعده «لاضرر، اتلاف، غرور»، بتوان خسارت ناشی از سامانههای مذکور و مسئولیت مدنی تولیدکنندگان نرمافزارها را اثبات نمود. البته بررسی موضوع مورد تحقیق، بر اساس حقوق موضوعه و با تمسک به نظریههایی مانند «نظریه تقصیر، ایجاد خطر، مختلط، تضمین حق و نظریه مسئولیت محض» به نظر راه را برای بررسی فقهی مسئله هموارتر میسازد. نتیجه اجمالی نوشتار حاضر، ثبوت ضمان و عدم رفع مسئولیت تولیدکنندگان سامانههای دیجیتالی و نرمافزاری به علت نقص است.
Digital and software systems are undoubtedly the lifeblood of the information society, which today plays a huge role in the economy and employment of society, so the expansion of their use in various aspects of life has created a flaw in this area. Contemplation of jurisprudential rules such as the 'principle of no harm', or loss, along with rules such as pride and according to our general rule, which is based on the principle of creation, and the lack of understanding, can raise the foundations of the destruction of these systems based on the shortcomings of human science. Based on the subject law and theories such as fault theory, risk creation, guaranteeing the right and the theory of pure responsibility, it has created a challenge and civil liability due to the fault of the above-mentioned systems. In this article, while explaining and analyzing different views, as a result, the rule of guarantee indicates that the producers of digital and software systems cannot be held accountable due to a defect in human science. Therefore, the builders of these systems, based on their civil liability and moral commitment, are required to deliver the above-mentioned systems without any defects and to compensate for any possible damages. .
