چکیده:
ناقشت الدراسة مسؤولية استخدام السفن الملاحية في القيام بالأفعال التي يعاقب عليها القانون بالجرائم الإرهابية التي تعرقل
السير المنتظم للملاحة البحرية والمسؤولية الدولية على الدولة التي اخلت بالتزاماتها على نحو يرتب ضرر بدولة ما والمسؤولية
الجنائية في حالة ارتكاب الدولة لجريمة الإرهاب البحري باسمها ولحسابها، وناقشت الدراسة مدى ملائمة أساليب الحماية
الجنائية للملاحة البحرية لمواجهة الإرهاب البحري على المستوى الوطني وأحكام المسؤولية عن جرائم الإرهاب البحري التي تنطوي
على مختلف أنواع العنف للوسائل المستخدمة من تدمير السفينة أو إلحاق الضرر بها أو بحمولتها مما يمكن أن يعرض السفينة
لخطر الملاحة الآمنة بالقيام بأي وسيلة كانت تؤدي إلى تدميرها أو إلحاق الضرر بها أو بطاقمها مما يعرض للخطر أو يعرض السفينة
للخطر, وتوصلت الدراسة أن أعمال العنف البحري ارتبطت باستخدام الإنسان للبحر ونتيجة لتعارض المصالح بين البشر ظهر
العنف وخاصة في الأنشطة التجارية البحرية فأن القيود التي فرضتها بعض الاتفاقيات الدولية خلقت صورة من صور العنف
البحري متمثلة بالقرصنة البحرية والسطو المسلح على السفن والتي تتم في أعالي البحار أو في مناطق لا تخضع لسيادة دولة معينة.
استخدمت الباحثة المنهج الوصفي التحليلي في شرح وتحليل الجرائم الإرهابية الناشئة عن استخدام السفن الملاحية للقيام
بالأعمال الإرهابية، مقارنة بالتشريعات الدولية والاتفاقيات الدولية لقمع الأعمال غير المشروعة ضد الملاحة البحرية والمتمثلة في
اتفاقية روما 0233 وبروتوكول قمع الأعمال غير المشروعة الموجهة ضد سلامة الجرف القاري والبروتوكول المكمل لها لتشمل عدد
من الجرائم الإرهابية البحرية الإضافية واختتمت الدراسة بالنتائج والتوصيات

of Criminal protection methods for maritime navigation to confront maritime terrorism at the national level and the
provisions of responsibility for maritime terrorism crimes that involve various types of violence for the means used
to destroy the ship or damage it or its cargo, which may expose the ship to the danger of safe navigation by carrying
out any means that leads to its destruction or Damage to it or its crew, which endangers the ship or endangers the
ship, and the study found that acts of maritime violence were associated with human use of the sea, and as a result
of conflict of interests between humans, violence appeared, especially in maritime commercial activities, the
restrictions imposed by some international agreements created a form of maritime violence represented by piracy
Naval robbery and armed robbery of ships that take place in the high seas or in areas not subject to the sovereignty
of a particular state.
The researcher used the descriptive analytical approach in explaining and analyzing terrorist crimes arising from the
use of navigational vessels to carry out terrorist acts, in comparison with international legislation and international
agreements to suppress illegal acts against maritime navigation represented in the Rome Convention 1988 and the
Protocol for the Suppression of Unlawful Acts against the Safety of the Continental Shelf and its complementary
protocol to include A number of additional maritime terrorist crimes, and the study concluded with results and
recommendations
