چکیده:
ملخص الدراسة حاولنا توضیح اختصاص المحاکم الجزائیة وصلاحیتها فی تنظیم الإجراءات التی تتخذها السلطات المختصة علی أثر ارتکاب الجرائم، وفقاً لقانون الإجراءات الجزائیة الذی حدد سلطة الاستدلال والإجراءات المنوطة بهم، وصلاحیات سلطات التحقیق الإبتدائی، وضمانات المتهم، وقواعد اختصاص المحاکم، کما نظم نظریة الإثبات الجنائی، وصلاحیة الدلیل، ونظم قواعد البطلان المتعلقة بالإجراءات الجزائیة، ونظم مرحلة المحاکمة وکیفیة صدور الأحکام، وحدد طرق الطعن فی الأحکام الجزائیة، وضمانات وحقوق المتهم. فقد رکز القضاء الاتحادی وفقاً لنصوص الدستور علی دعامتین تتمثل الأولی فی المحکمة الاتحادیة العلیا والتی تختص بالفصل فی المنازعات المختلفة التی تثور بین الإمارات الأعضاء فی الاتحاد وبین أیة إمارة أو أکثر وبین حکومة الاتحاد وبحث دستوریة القوانین وتفسیر أحکام الدستور وتنازع الاختصاص بین القضاء الاتحادی والهیئات القضائیة المحلیة وفقاً للمادة (99) من الدستور، وأن الدعامة الثانیة فی المحاکم الاتحادیة الابتدائیة التی تنعقد فی عاصمة الاتحاد أو عواصم الإمارات لممارسة الولایة القضائیة فی دوائر اختصاصها فی المنازعات المدنیة والتجاریة والإداریة التی تثور بین الاتحاد والأفراد، والجرائم التی ترتکب ضمن حدود العاصمة الاتحادیة وقضایا الأحوال الشخصیة والقضایا المدنیة والتجاریة وغیرها وفقاً للمادة (102) من الدستور.
We tried to clarify the jurisdiction of the criminal courts and their authority to
regulate the actions taken by the competent authorities in the wake of the commission
of crimes, according to the Law of Criminal Procedure that specified the authority of
reasoning and the procedures assigned to them, the powers of the primary investigation
authorities, the guarantees of the accused, the rules of jurisdiction of the courts, as well
as the systems of criminal evidence theory, and the validity of evidence And regulate
the rules of nullity related to criminal procedures, the systems of the trial stage and how
judgments are issued, and specify the methods for challenging criminal rulings,
guarantees and rights of the accused.
In accordance with the provisions of the constitution, the federal judiciary focused
on two pillars, the first of which is the Supreme Federal Court, which is concerned with
adjudicating the various disputes that arise between the member Emirates of the
Federation and between any or more emirates and between the Union government and
researching the constitutionality of laws and interpretation of the provisions of the
constitution and conflicts of jurisdiction between the federal judiciary and local judicial
bodies According to Article (99) of the Constitution, and that the second pillar of the
federal courts of first instance that are held in the capital of the Federation or the capitals
of the Emirates to exercise jurisdiction in its jurisdiction in civil, commercial and
administrative disputes that arise between the Union and individuals, crimes committed
within the limits of the federal capital and personal status issues And civil, commercial
and other cases in accordance with Article (102) of the Constitution.
