چکیده:
La finance islamique est un nouveau écosystème financier qui opte pour l'économie éthique et solidaire ayant émergé comme une riposte aux dérives du système financier actuel caractérisé par une succession de crises dont la plus importante est de 2008. Dans cette perspective, les banques participatives se sont érigées en une alternative aux banques conventionnelles et qui offrent des produits conformes aux principes et règles de la chariaa et aux préceptes du Coran. Dans ce contexte, le législateur a mis en place des instances pour assurer la supervision des activités de ces banques et donner des avis sur leur conformité aux préceptes de l'Islam ou non. Pour ce faire, le conseil supérieur des Oulémas s'est fait attribué de larges compétences de fatouas en la matière par le biais d'une commission des finances participatives au sein de ce dit conseil. De même, nous avons essayé, dans le cadre ce travail modeste, d' apporter quelques éclairages sur les mécanismes juridiques et les fondements théoriques des différents produits offerts par ces banques participatives tout en procédant à des comparaisons analytiques avec les contrats des banques classiques similaires.
Islamic finance is a new financial ecosystem which opts for the ethical and united economy
which emerged as a response to the excesses of the current financial system and which was
characterized by a succession of crises, the most important of which was in 2008. In this
perspective , the participating banks have set themselves up as an alternative to conventional
banks and which offer products that comply with the principles and rules of sharia law and the
precepts of the Koran.
In this context, the legislator has set up bodies to ensure the supervision of the activities of
these banks and to give opinions on their conformity to the precepts of Islam or not. To do this,
the Superior Council of the Ulemas has been given wide powers of fatouas through a
participatory finance committee within this said council.
Likewise, we have tried, within the framework of this modest work, to shed some light
on the legal mechanisms and the theoretical foundations of the various products offered by these
participating banks while proceeding to analytical comparisons with the contracts of similar
conventional banks.
