چکیده:
بدن آدمی نقشی غیرقابل انکار در تکوین شخصیت وی ایفا میکند. امروزه، با اتکا به تلاشهای علمی صورتگرفته، میتوان با طیفواره قلمداد کردن جنس، و به تبع آن جنسیت، شاهد جنس و جنسیت بینابین بود؛ وضعیتی که مدتها «اختلال» انگاشته میشد و امروزه صرفاً تجربهای «متفاوت» از دو کهنالگوی جنسی زنانه و مردانه قلمداد میشود. بدین ترتیب و همراستا با تلاشهای علمی صورتگرفته، فرآیند شناسایی حقوقی بیناجنسیتیها به مثابهِ افرادی ذیشعور، کرامتمند و خودآئین آغاز گردیده است؛ فرآیندی که همچنان مراحل آغازین خود را در بسیاری از کشورها طی ننموده است. شناسایی حقوقی، کنشی است که طی زمان و متأثر از پویایی دو مفهوم «جنس» و «جنسیت»، یک سر خود را به فاعل شناسایی و سوی دیگر را به موضوع شناسایی حقوقی یعنی بیناجنسیتیها گره میزند. حاصل این کنش ارتباطی دو الگو از شناسایی حقوقی است که در سویه منفی، از رهگذار انحصار جنس و جنسیت در دوگانۀ زن- مرد و تحمیل اعمال جراحی غیرضروری بر فرد بیناجنسیت، وی را به یکی از این دوگانه ملحق میسازد. اما در شناسایی حقوقی مثبت، با معرفی عناصر مؤلفی چون حق بر تعیین سرنوشت، حق بر تمامیت جسمانی و حق بر داشتن آلت جنسی دستناخورده، الگویی حقبنیاد از شناسایی حقوقی بیناجنسیتیها برساخته میشود؛ الگویی که ضرورت درمان و رضایت آگاهانۀ فرد بیناجنسیت محدودههای آن قلمداد میشوند. محدود نمودن این نوع از شناسایی حقوقی به این دو مولفه، بدان وجاهت تضمینگری بخشیده و بر قامت ایدۀ اصلی شناسایی حقوقی مثبت که همانا «برابری» انسان بیناجنسیت با انسان زنانه و مردانه است، لباس واقعیت میپوشاند.
Incontrovertibly each person’s body has an undeniable role in his shaping personality. Nowadays and based on scientific efforts, we know sex and accordingly, gender, as a spectrum in inter bodily experience. Over the long years intersex status was considered a “disorder”, but recently “different” experience of the two feminine and masculine sexual templates replaced the prevailing perception of intersex status. Concurrently with these scientific efforts, the process of legal recognition of intersex persons as conscious, dignified and autonomous persons has started; the process which is unknown in many countries.Legal recognition is an action that during the years, encapsulates the debate on the agent of recognition on the one hand and subject of legal recognition, intersex persons, on the other hand. Birth of positive and negative legal recognition is the result of this action and reaction. In negative legal recognition, only the two feminine and masculine sexual patterns are recognized and intersex persons have to undertake the burden of irreparable and dangerous surgical shaping to join one of the two, without informed consent and necessity of treatment. But in positive legal recognition, existence of component elements such as right to self-determination, right to bodily integrity and right to have infant genitalia, creates a right-based model of legal recognition of intersex persons; a model that informed consent and necessity of treatment comprise its limitations to guarantee mentioned rights and actualize the fundamental idea of positive legal recognition, i.e. the equity between intersex and male or female humane.
