چکیده:
ماده 50 قانون بیمه اجباری مصوب 1395 بنا به مصالحی همچون پیشگیری از صدور آرای متعارض، کاهش میزان پروندهها، شناسایی دعاوی واهی و پیشگیری از ایراد امر قضاوت شده وضع گردیده است و تطبیق این ماده با مقررات آیین دادرسی مدنی و کیفری، حکایت از تفاوت میزان دخالت بیمهگر در دعاوی کیفری و حقوقی دارد. مدیریت دعاوی بیمه نقش مهمی در کارایی اقتصادی شرکتهای بیمه و کاهش میزان پروندههای طرح شده علیه آنها دارد. مدیریت این دعاوی مستلزم دخالت مؤثر بیمهگر در دادرسی است که با توجه به پیچیدگیهای مقررات آیین دادرسی مدنی و کیفری کار آسانی نیست. در این پژوهش به شیوه توصیفی و تحلیلی بیان خواهد شد که ماده 50 قانون بیمه اجباری مصوب 1395 به عنوان یک تأسیس خاص، حق ویژهای برای دخالت بیمهگر در دعاوی حقوقی و کیفری در نظر گرفته و در جمع این مقرره با تشریفات آیین دادرسی مدنی و کیفری باید گفت که دخالت بیمهگر در مقام مدیریت دعاوی حقوقی و کیفری، تحت نظارت مقام قضایی میسر است و اگر بیمهگر مدعی حق مستقلی باشد، مکلف به طرح دعوا مطابق مقررات است.
