چکیده:
زمینه و هدف: جرایم اقتصادی به خاطر تاثیر گذار بودن بر تمام سطوح جامعه، یکی از مسائل چالش برانگیز در جهان می-باشند که ایران نیز از این امر مستثنی نیست. فضای اقتصادی ایران هم به دلیل ابتلا به آسیبهای عدیده، نسبت به نظام های اقتصادی مثل کشور فرانسه، زمینه مساعدتری برای ارتکاب جرم اقتصادی ایجاد میکند، گسترش جرایم اقتصادی مانع دستیابی دولت به اهداف ملی در حوزه امنیت اقتصادی شده و جرایم عمومی را به مخاطره میاندازد. روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است.یافته ها و نتایج: قانون مجازات اسلامی برای نخستین بار به روش«تبیین حصری مصادیق» مفهومی از جرم اقتصادی ارائه کرده است. که تا حدودی میتوان گفت مصادیقی از جرایم اقتصادی بیان شده است. انتقادی که بر جرایم اقتصادی در سیاست کیفری کنونی ایران وارد است این مطلب است که برخی از جرایم مانند جرایم حوزه بازار اوراق بهادار از شمول تعریف خارج مانده اند و برخی از جرایم که صبغه اقتصادی ندارند و تنها میتوانند با جرایم اقتصادی ارتباطی داشته باشند، مانند اعلام نکردن وقوع این جرایم از سوی مقامات رسمی، داخل در جرایم اقتصادی قرار گرفته اند. برخلاف حقوق فرانسه، در سیاست کیفری ایران، دبه ویژه از منظر حقوقِ شکلی، رویکرد منسجم و منظمی نداشته و رژیم افتراقی برای مبارزه با این جرایم درنظر گرفته نشده است و با وجود تصریح به »دادسرای ویژة جرایم اقتصادی« در مادة 25 قانون آیین دادرسی کیفریِ که در ماهیّت تخصصی است و صلاحیت ذاتی ندارد، دادگاه اختصاصی برای این جرایم پیش بینی نشده است.
Field and Aims: Economic crimes are one of the most challenging issues in the world due to their impact on all levels of society, and Iran is no exception. Iran's economic environment creates a more favorable environment for committing economic crimes than economic systems like France due to suffering from many injuries. The spread of economic crimes prevents the government from achieving its national goals in the field of economic security and endangers public crimes.
Method: The present research is done in a descriptive and analytical way.
Finding and Conclusion: For the first time, the Islamic Penal Code has presented a concept of economic crime by the method of "Exclusive Explanation of Examples". To some extent, it can be said that examples of economic crimes have been stated. The criticism of economic crimes in Iran's current criminal policy is that some crimes, such as securities market crimes, are excluded from the definition and some crimes that do not have an economic nature and can only be related to economic crimes, such as not announcing the occurrence of these crimes by official authorities, are included in economic crimes. unlike French law, Iran's penal policy does not have a coherent and regular approach from the point of view of formal law, and a differential regime has not been considered to fight these crimes and despite the specification of a "Special Court for Economic Crimes" in Article 25 of the Criminal Procedure Law, which is specialized in nature and has no inherent jurisdiction, a special court is not provided for these crimes.
