چکیده:
جزایر مصنوعی خسارات زیست محیطی متعددی را افزون بر پیامدهای مثبتی که دارند، ایجاد مینمایند. ساخت جزایر مصنوعی از سوی کشورهای حاشیهی دریای خزر، سبب شده تا این موضوع با حساسیت بیشتری از سوی ایران دنبال شده و در چنین شرایطی، تبعات زیست محیطی و حقوقی این مسئله هم نباید مغفول بماند. در کنار آلودگیهای زیست محیطی ناشی از فعالیتهای انسانی و بهرهبرداری بیرویه از طبیعت، آلودگی آبها هم در منطقهی دریایی خزر، بخش عمدهای از بحران سلامت اکوسیستم دریایی این خطه را تشکیل میدهد. اگرچه برخی از کشورهای مجاور این دریا، تلاش دارند تا سهم اراضی تحت مالکیت خود را با ایجاد جزایر مصنوعی برای فعالیتهای اقتصادی، توریستی و تجاری خود افزایش دهند، اما تاسیس این سازهها در دریای خزر، باعث بر هم زدن سلامت اکوسیستم طبیعی دریای خزر میشوند. نوشتار سلامت اکوسیستم دریایی دریای خزر و اعتراض ایران به احداث جزایر در دریای خزر بخاطر مسایل زیست محیطی آنها، بر مبنای مقررات حقوق بینالملل و با استناد به دعوای مالزی علیه سنگاپور، دعوای هلند علیه روسیه و مسئولیت بینالمللی دولتها مورد تجزیه و تحلیل قرار گرفته است. یافتههای این پژوهش نشان میدهد که مطابق با حقوق بینالملل دریاها، احداث جزایر مصنوعی ممنوع نیست، اما ایجاد آنها طبق رویهی قضایی بینالمللی مشروط به رعایت حقوق کشورهای همجوار و ارزیابی خسارات زیست محیطی آنها و به آگاهی رسانیدن کشورهای مجاور میباشد. این پژوهش از نوع نظری بوده، روش تحقیق آن به صورت توصیفی و تحلیلی میباشد و روش جمعآوری اطلاعات آن، کتابخانهای و با مراجعه به اسناد بینالمللی، کتب و مقالهها انجام شده است.
The construction of artificial islands causes numerous environmental damage in addition to their positive consequences. The construction of artificial islands by the Caspian littoral states has caused this issue to be pursued more sensitively by Iran, and in such circumstances, the environmental and legal consequences of this issue should not be overlooked. In addition to environmental pollution caused by human activities and improper exploitation of nature, water pollution in the Caspian Sea region is a major part of the marine ecosystem health crisis of this region. Although some neighboring countries are trying to increase their share of land ownership by creating artificial islands for their economic, tourist and commercial activities, the establishment of these structures in the Caspian Sea is disrupting the health of the natural ecosystem of the Caspian Sea. The health text of the Caspian Sea ecosystem and Iran's protest against the construction of an island in the Caspian Sea due to their environmental issues has been analyzed in accordance with international law, Malaysia v. Singapore, the Netherlands v. Russia, and the international responsibility of states. The findings of this study show that in accordance with the international law of the sea, the construction of artificial islands is not prohibited, but their creation according to international jurisprudence is subject to respecting the rights of neighboring countries and assessing their environmental damage and informing neighboring countries. This research is of theoretical type, its research method is descriptive and analytical and its data collection method is library and with reference to international documents, books and articles.
