چکیده:
پویایی فقه شیعه در پرتو ظرفیت های بالقوه حکم حکومتی و توجه بیش از پیش به عناوین ثانوی است. اعمال مجازات های بدنی(رجم، تازیانه، قطع عضو و اعدام) به عنوان حد، مغایر تعهدات حقوق بشری نظام جمهوری اسلامی ایران دانسته شده و واکنش هایی را در پی داشته است. در میثاق بین المللی حقوق مدنی و سیاسی که دولت ایران طرف آن است، مجازات یا رفتارهای بی رحمانه، غیر انسانی و تحقیرآمیز منع و بر تعدیل، تبدیل و اسقاط برخی از مجازات ها،تأکید شده است.حاصل این پژوهش که به روش توصیفی- تحلیلی نگاشته شده، بیانگر آن است که با توجه به قاعده فقهی لاحرج و گرایش های جهانی بر عدم اعمال مجازات های بدنی، امکان تعدیل، تبدیل و اسقاط مجازات های مذکور وجود دارد. اگر چه مقتضای حکم اولی، ثبات و تبدیل ناپذیری مجازات های های بدنی حدی، اما با توجه به نظرهای تفسیری نهادهای حقوق بشری و چالش های موجود، صدور حکم حکومتی بر مبنای«لاحرج»، امکان پذیر و به طور موقت قابل اثبات است و حاکم اسلامی در تحدید مجازات های بدنی، اختیار دارد. دادگاه های ایران با تشخیص ولی فقیه، می تواند اعمال مجازات های بدنی را به حداقل رسانده و موجب اجتناب از مسئولیت بین المللی دولت و حفظ مصالح نظام شوند.
The dynamic of Shia jurisprudence is in the light of the potential capacities of the government ruling and paying more attention to secondary titles. Applying corporal punishments (stoning, whipping, amputation and execution) as a limit is considered contrary to the human rights obligations of the Islamic Republic of Iran and has caused reactions.In the International Covenant on Civil and Political Rights, to which the Iranian government is a party, punishment or cruel, inhuman and humiliating behavior is prohibited and emphasis is placed on the adjustment, transformation and cancellation of some punishments.The result of this research, which was written in a descriptive-analytical way, indicates that according to the jurisprudence rule of lahrij and global trends on not applying corporal punishments, there is a possibility of adjusting, converting and abolishing the said punishments. Although the requirement of the first ruling is the stability and irreversibility of limited corporal punishments, but according to the interpretive opinions of human rights institutions and the existing challenges, the issuance of a government ruling based on "laharij" is possible and temporarily provable, and the ruling Islam has authority in limiting corporal punishments. Iran's courts can minimize the use of corporal punishment by recognizing the legal guardian and avoid the international responsibility of the government and protect the interests of the system.
