چکیده:
چکیده نکاح معاطاتی یکی از مباحث چالشی و مهم در حیطه فقه خانواده است. منظور از نکاح معاطاتی انعقاد رابطه زوجیت بدون صیغه ایجاب و قبول است. برخی فقها با پذیرش این نکته که الفاظ در تحقق ایجاب و قبول موضوعیتی ندارند، مدعی صحت نکاح معاطاتی شده اند؛ اما قول مشهور عدم صحت چنین عقدی که توسط امام خمینی(ره) بیان شده است. به نظر می رسد با وجود آیات و روایات، اجماع و سیره مسلمین، قول مشهور از قوت بیشتری برخوردار است. از دیدگاه امام خمینی(ره) مقتضای قاعده جریان معاطات در هر عقد و ایقاعی است که انشای آن به فعل ممکن باشد؛ زیرا فعل نیز مانند قول، وسیله ایجاد و ایقاع اعتباری است. در نتیجه در این مقاله به تبیبن فقهی حقوقی ازدواج بدون عقد لفظی(معاطاتی) از دیدگاه امام خمینی (ره) پرداخته شد. بدین منظور به رشو تحلیلی توصیفی و در راستای بررسی این موضوع، با درنظر گرفتن آرای امام خمینی و دیگر فقها، صحت نکاح معاطاتی واکاوی شده است.
Ma'atati marriage is one of the challenging and important issues in the field of family jurisprudence. The meaning of matrimonial marriage is the conclusion of a marriage relationship without a contract of acceptance and request. Some jurists, by accepting the point that words are not relevant in the fulfillment of demand and acceptance, have claimed the validity of the matrimonial marriage; But the famous saying of the inauthenticity of such a marriage, which was expressed by Imam Khomeini (RA). It seems that despite the verses and hadiths, the consensus and the way of Muslims, the famous saying is more powerful. From Imam Khomeini's point of view, it is necessary for the rule of flow of communication in every marriage and occasion that it is possible to compose it with a verb; Because the verb, like the word, is a means of creating and creating credit. As a result, in this article, the legal jurisprudence of marriage without verbal contract (ma'atati) was discussed from the point of view of Imam Khomeini (RA). For this purpose, the validity of Ma'atati marriage has been analyzed by descriptive analytical method and in line with the investigation of this issue, taking into account the opinions of Imam Khomeini and other jurists.
